{"id":1329,"date":"2006-03-01T00:00:00","date_gmt":"2006-02-28T22:00:00","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/2006\/03\/la-loi-toubon-toujours-dactualite\/"},"modified":"2006-03-01T00:00:00","modified_gmt":"2006-02-28T22:00:00","slug":"la-loi-toubon-toujours-dactualite","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2006\/03\/01\/la-loi-toubon-toujours-dactualite\/","title":{"rendered":"La Loi Toubon toujours d&#039;actualit\u00e9"},"content":{"rendered":"<h3>Principes<\/h3>\n<p>\u00ab\u00a0L&rsquo;articleL 122-39-1 du code du travail (cf. texte int\u00e9gral ci-dessous) \u00e9dictedes obligations \u00e0 la charge de l&#8217;employeur et d\u00e9finit pr\u00e9cis\u00e9ment lep\u00e9rim\u00e8tre de l&rsquo;obligation de l&#8217;employeur en visant express\u00e9ment lanature des documents devant \u00eatre r\u00e9dig\u00e9s ou traduits en languefran\u00e7aise. <\/p>\n<p>L&rsquo;obligation mise \u00e0 la charge de l&#8217;employeur concerne non seulement le domaine de l&rsquo;hygi\u00e8ne et la s\u00e9curit\u00e9, mais a <b>une port\u00e9e g\u00e9n\u00e9rale<\/b>. <b>L&rsquo;objectifde la loi Toubon du 4 ao\u00fbt 1994 est d&rsquo;imposer l&rsquo;usage obligatoire maisnon exclusif de la langue fran\u00e7aise dans des domaines d\u00e9termin\u00e9s, dontcelui du travail de salari\u00e9s au sein de l&rsquo;entreprise sise en France. <\/b><span style=\"font-weight: bold;\"><br \/><\/span><\/p>\n<p><span style=\"font-weight: bold;\">\u00a0<\/span>L&rsquo;article ins\u00e9r\u00e9 dans le code du travail vise <b>toutdocument dont la connaissance est n\u00e9cessaire au salari\u00e9 pour la bonneex\u00e9cution de son travail dans le respect de son contrat de travail etdes r\u00e8gles d&rsquo;hygi\u00e8ne et de s\u00e9curit\u00e9<\/b>. Ainsi, l&rsquo;obligation detraduction en langue fran\u00e7aise vise les documents techniques portantsur des produits fabriqu\u00e9s pr\u00e9sents sur le march\u00e9 fran\u00e7ais et ceux quela soci\u00e9t\u00e9 fabriquera destin\u00e9s au march\u00e9 fran\u00e7ais qui sont n\u00e9cessairesaux salari\u00e9s fran\u00e7ais pour la bonne ex\u00e9cution de leur travail enFrance. <\/p>\n<p>En d\u00e9finitive, <b>seuls lesdocuments accompagnant les produits re\u00e7us de l&rsquo;\u00e9tranger et ceuxaccompagnant les produits destin\u00e9s \u00e0 l&rsquo;\u00e9tranger rel\u00e8vent de l&rsquo;exception\u00e0 l&rsquo;obligation de r\u00e9daction et\/ou traduction en langue fran\u00e7aise\u00a0\u00bb. <\/b><span style=\"font-weight: bold;\"><br \/><\/span><\/p>\n<p><span style=\"font-weight: bold;\">\u00a0<\/span>En outre, la Cour d&rsquo;appel dans l&rsquo;un de ses consid\u00e9rants pr\u00e9cise que \u00ab\u00a0lefait que le non respect des dispositions de l&rsquo;article L 122-39-1 ducode du Travail soit p\u00e9nalement sanctionn\u00e9, n&rsquo;interdit pas au jugecivil, saisi d&rsquo;une demande aux fins d&rsquo;obtenir le respect del&rsquo;obligation incombant \u00e0 l&#8217;employeur, de constater le manquement \u00e0l&rsquo;obligation qui caract\u00e9rise en soi une faute civile dont la r\u00e9parationpeut \u00eatre poursuivie devant le juge civil au choix des cr\u00e9anciers del&rsquo;obligation ou de ceux qui ont qualit\u00e9 \u00e0 agir pour eux, d\u00e8s lors quel&rsquo;int\u00e9r\u00eat collectif des salari\u00e9s est concern\u00e9\u00a0\u00bb.<\/p>\n<p> Source : CA Versailles, 1re ch., 1re sect., 2 mars 2006<\/p>\n<h3>Le texte de r\u00e9f\u00e9rence<\/h3>\n<h4>Article L.122-39-1 du Code du Travail<\/h4>\n<p>(ins\u00e9r\u00e9 par Loi n\u00ba 94-665 du 4 ao\u00fbt 1994 art. 9 II Journal Officiel du 5 ao\u00fbt 1994)<\/p>\n<p>Tout document comportant des obligations pour le salari\u00e9 ou desdispositions dont la connaissance est n\u00e9cessaire \u00e0 celui-ci pourl&rsquo;ex\u00e9cution de son travail doit \u00eatre r\u00e9dig\u00e9 en fran\u00e7ais. \u00b0Dispositionsd\u00e9clar\u00e9es non conformes \u00e0 la Constitution par d\u00e9cision du Conseilconstitutionnel n\u00ba 94-345 DC du 29 juillet 1994.] Il peut \u00eatreaccompagn\u00e9 de traductions en une ou plusieurs langues \u00e9trang\u00e8res.<br \/> Ces dispositions ne sont pas applicables aux documents re\u00e7us de l&rsquo;\u00e9tranger ou destin\u00e9s \u00e0 des \u00e9trangers.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Principes \u00ab\u00a0L&rsquo;articleL 122-39-1 du code du travail (cf. texte int\u00e9gral ci-dessous) \u00e9dictedes obligations \u00e0 la charge de l&#8217;employeur et d\u00e9finit pr\u00e9cis\u00e9ment lep\u00e9rim\u00e8tre de l&rsquo;obligation de l&#8217;employeur en visant express\u00e9ment lanature des documents devant \u00eatre r\u00e9dig\u00e9s ou traduits en languefran\u00e7aise.
