{"id":1374,"date":"2009-04-08T00:00:00","date_gmt":"2009-04-07T22:00:00","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/2009\/04\/definition-le-conge-de-mobilite\/"},"modified":"2009-04-08T00:00:00","modified_gmt":"2009-04-07T22:00:00","slug":"definition-le-conge-de-mobilite","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2009\/04\/08\/definition-le-conge-de-mobilite\/","title":{"rendered":"D\u00e9finition : le cong\u00e9 de mobilit\u00e9"},"content":{"rendered":"<p>Le cong\u00e9 de mobilit\u00e9 vise \u00e0 <span style=\"font-weight: bold;\">favoriser le retour \u00e0 un emploi stable detout salari\u00e9 concern\u00e9 par un projet de licenciement <\/span>\u00e0 travers desmesures d&rsquo;accompagnement, des actions de formation et des p\u00e9riodes detravail.<\/p>\n<p>Il permet ainsi au salari\u00e9 de <span style=\"font-weight: bold;\">disposer d&rsquo;un accompagnementavant la rupture de son contrat,<\/span> et \u00e9ventuellement l&rsquo;int\u00e9gration \u00e0 unnouveau poste.<\/p>\n<h3>B\u00e9n\u00e9ficiaires :<\/h3>\n<p>Peuvent b\u00e9n\u00e9ficier de ce cong\u00e9 <span style=\"font-weight: bold;\">les salari\u00e9s concern\u00e9s par une proc\u00e9dure de licenciement \u00e9conomique<\/span> d\u00e8s lors que leur entreprise :    <\/p>\n<li>est soumise \u00e0 <span style=\"font-weight: bold;\">l&rsquo;obligation de proposer un cong\u00e9 de reclassement, <\/span><\/li>\n<li>a conclu <span style=\"font-weight: bold;\">un accord collectif relatif \u00e0 la gestion pr\u00e9visionnelle des emplois et des comp\u00e9tences. (GPEC)<\/span><\/li>\n<h3>Nature du cong\u00e9 <\/h3>\n<p>Les p\u00e9riodes de travail propos\u00e9es aux salari\u00e9s peuvent \u00eatre accomplies <span style=\"font-weight: bold;\">au sein ou en dehors de l&rsquo;entreprise<\/span> qui a propos\u00e9 le cong\u00e9 de mobilit\u00e9. <\/p>\n<p>Elles peuvent prendre la forme <span style=\"font-weight: bold;\">soit d&rsquo;un CDD (lorsqu&rsquo;elles concernent des contrats conclus au titre de la politique de l&#8217;emploi), soit d&rsquo;un CDI.<\/span> <\/p>\n<p>Lorsque la p\u00e9riode de travail prend la forme d&rsquo;un CDD, le cong\u00e9 de mobilit\u00e9 est suspendu et reprend \u00e0 l&rsquo;issue du contrat pour la dur\u00e9e restant \u00e0 courir.\u00a0 <\/p>\n<h3>P\u00e9riode d&rsquo;accomplissement <\/h3>\n<p>Le cong\u00e9 de mobilit\u00e9 est pris <span style=\"font-weight: bold;\">pendant la p\u00e9riode de pr\u00e9avis du salari\u00e9. <\/span>Dans ce cas, le salari\u00e9 est dispens\u00e9 d&rsquo;ex\u00e9cuter le pr\u00e9avis. <\/p>\n<p>Lorsque la dur\u00e9e du cong\u00e9 exc\u00e8de la dur\u00e9e du pr\u00e9avis, le terme du pr\u00e9avis est report\u00e9 jusqu&rsquo;\u00e0 la fin du cong\u00e9. <\/p>\n<h3>Dur\u00e9e <br \/><\/h3>\n<p>La dur\u00e9e du cong\u00e9 est fix\u00e9e par l&rsquo;accord collectif.\u00a0<\/p>\n<h3>Contenu de l&rsquo;accord collectif<br \/><\/h3>\n<p>L&rsquo;accord collectif d\u00e9termine<span style=\"font-weight: bold;\"> les conditions que doit remplir le salari\u00e9 pour b\u00e9n\u00e9ficier du cong\u00e9 de mobilit\u00e9. <\/span><\/p>\n<p>Son contenu :    <\/p>\n<li>fixe <span style=\"font-weight: bold;\">les modalit\u00e9s d&rsquo;adh\u00e9sion<\/span> du salari\u00e9 \u00e0 la proposition de l&#8217;employeur et leurs engagements respectifs, <\/li>\n<li>organise <span style=\"font-weight: bold;\">les p\u00e9riodes de travail,<\/span> les conditions suivant lesquelles il est mis fin au cong\u00e9 et les modalit\u00e9s d&rsquo;accompagnement des actions de formation envisag\u00e9es, <\/li>\n<li>d\u00e9termine <span style=\"font-weight: bold;\">le niveau de la r\u00e9mun\u00e9ration<\/span> qui sera vers\u00e9e pendant la p\u00e9riode du cong\u00e9 qui exc\u00e8de le pr\u00e9avis, <\/li>\n<li>pr\u00e9voit<span style=\"font-weight: bold;\"> les conditions d&rsquo;information des institutions repr\u00e9sentatives du personnel <\/span>lorsque l&#8217;employeur propose \u00e0 ses salari\u00e9s un cong\u00e9 de mobilit\u00e9, <\/li>\n<li>d\u00e9termine <span style=\"font-weight: bold;\">les indemnit\u00e9s de rupture<\/span> garanties au salari\u00e9. <\/li>\n<p><\/p>\n<h3>R\u00e9mun\u00e9ration <br \/><\/h3>\n<p>Lorsque le cong\u00e9 de mobilit\u00e9 est effectu\u00e9 pendant la dur\u00e9e du pr\u00e9avis, le salari\u00e9 per\u00f4oit <span style=\"font-weight: bold;\">son salaire habituel. <\/span><\/p>\n<p>Si le cong\u00e9 se prolonge au-del\u00e0 de la dur\u00e9e du pr\u00e9avis, la r\u00e9mun\u00e9ration est fix\u00e9e : \u00a0   <\/p>\n<li>au minimum \u00e0 <span style=\"font-weight: bold;\">65% de la r\u00e9mun\u00e9ration brute moyenne des 12 derniers mois, <\/span><\/li>\n<li>ou, en tout \u00e9tat de cause, \u00e0 <span style=\"font-weight: bold;\">85% du SMIC brut minimum.<\/span><\/li>\n<p> La r\u00e9mun\u00e9ration vers\u00e9e est exon\u00e9r\u00e9e de cotisations sociales au maximum pendant <span style=\"font-weight: bold;\">les 9 premiers mois<\/span> du cong\u00e9. <\/p>\n<p>Cependant, elle n&rsquo;est pas exon\u00e9r\u00e9e de <span style=\"font-weight: bold;\">la contribution sociale g\u00e9n\u00e9ralis\u00e9e (CSG) et la de contribution au remboursement de la dette sociale (CRDS) . \u00a0<\/span><\/p>\n<h3>En cas d&rsquo;acceptation du dispositif<br \/><\/h3>\n<p>Si le salari\u00e9 accepte la proposition de cong\u00e9 de mobilit\u00e9 :    <\/p>\n<li><span style=\"font-weight: bold;\">son contrat de travail est rompu <\/span>d&rsquo;un commun accord avec son employeur \u00e0 l&rsquo;issue du cong\u00e9, <\/li>\n<li>l&#8217;employeur n&rsquo;a plus l&rsquo;obligation de lui proposer <span style=\"font-weight: bold;\">un cong\u00e9 de reclassement.<\/span><\/li>\n<p><span style=\"font-weight: bold;\"><br \/><\/span> <span style=\"font-style: italic;\">Source : Minist\u00e8re du Travail, des Relations Sociales, de la Famille, de la Solidarit\u00e9 et de la Ville, service-public.fr<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le cong\u00e9 de mobilit\u00e9 vise \u00e0 favoriser le retour \u00e0 un emploi stable detout salari\u00e9 concern\u00e9 par un projet de licenciement \u00e0 travers desmesures d&rsquo;accompagnement, des actions de formation et des p\u00e9riodes detravail.
