{"id":1409,"date":"2011-09-08T00:00:00","date_gmt":"2011-09-07T22:00:00","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/2011\/09\/les-nouvelles-modalites-de-la-declaration-prealable-a-lembauche\/"},"modified":"2011-09-08T00:00:00","modified_gmt":"2011-09-07T22:00:00","slug":"les-nouvelles-modalites-de-la-declaration-prealable-a-lembauche","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2011\/09\/08\/les-nouvelles-modalites-de-la-declaration-prealable-a-lembauche\/","title":{"rendered":"Les nouvelles modalit\u00e9s de la d\u00e9claration pr\u00e9alable \u00e0 l&#039;embauche"},"content":{"rendered":"<p>Depuis le 1er ao\u00fbt 2011, la D\u00e9claration Unique d&rsquo;Embauche (DUE) et la D\u00e9claration Pr\u00e9alable \u00e0 l&rsquo;Embauche (DPAE) ont fusionn\u00e9.<\/p>\n<p>Textes de r\u00e9f\u00e9rence : Articles D 1221-1 et suivants du code du travail<\/p>\n<p>La d\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche contribue \u00e0 la simplification des d\u00e9marches li\u00e9es \u00e0 l&#8217;embauche.<\/p>\n<p>Cette d\u00e9claration obligatoire offre en effet la particularit\u00e9 de regrouper de nombreuses formalit\u00e9s.<\/p>\n<p>Au moyen de la d\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche, l&#8217;employeur accomplit les d\u00e9clarations et demandes suivantes :<\/p>\n<ol>\n<li>L&rsquo;immatriculation de l&#8217;employeur au r\u00e9gime g\u00e9n\u00e9ral de la s\u00e9curit\u00e9 sociale, s&rsquo;il s&rsquo;agit d&rsquo;un salari\u00e9 non agricole, <\/li>\n<li>L&rsquo;immatriculation du salari\u00e9 \u00e0 la caisse primaire d&rsquo;assurance <\/li>\n<li>L&rsquo;affiliation de l&#8217;employeur au r\u00e9gime d&rsquo;assurance ch\u00f4mage <\/li>\n<li>La demande d&rsquo;adh\u00e9sion \u00e0 un service de sant\u00e9 au travail, s&rsquo;il s&rsquo;agit d&rsquo;un salari\u00e9 non agricole<\/li>\n<li>La demande d&rsquo;examen m\u00e9dical d&#8217;embauche<\/li>\n<\/ol>\n<p>Toute embauche d&rsquo;un agent relevant du r\u00e9gime g\u00e9n\u00e9ral de la S\u00e9curit\u00e9 sociale, doit faire l&rsquo;objet d&rsquo;une DPAE.<br \/>Cette d\u00e9claration est obligatoire, quelles que soient les conditions d&rsquo;exercice de la profession et la dur\u00e9e d&rsquo;engagement.<\/p>\n<p>La d\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche est adress\u00e9e au plus t\u00f4t dans les huit jours pr\u00e9c\u00e9dant la date pr\u00e9visible de l&#8217;embauche.<\/p>\n<p>La d\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche est effectu\u00e9e par voie \u00e9lectronique ou sur un formulaire sp\u00e9cifique.<\/p>\n<p>L&#8217;employeur adresse ce formulaire, sign\u00e9 par lui, \u00e0 l&rsquo;URSSAF par t\u00e9l\u00e9copie ou par lettre recommand\u00e9e avec demande d&rsquo;avis de r\u00e9ception.<\/p>\n<p>Lorsqu&rsquo;il est transmis par t\u00e9l\u00e9copie, l&#8217;employeur conserve l&rsquo;avis de r\u00e9ception \u00e9mis par l&rsquo;appareil et le document qu&rsquo;il a transmis jusqu&rsquo;\u00e0 r\u00e9ception de l&rsquo;accus\u00e9 de r\u00e9ception reprenant les informations fournies.<\/p>\n<p>Lorsqu&rsquo;il est transmis par lettre recommand\u00e9e avec avis de r\u00e9ception, celle-ci est envoy\u00e9e au plus tard le dernier jour ouvrable pr\u00e9c\u00e9dant l&#8217;embauche, le cachet de la poste faisant foi. L&#8217;employeur conserve un double de la lettre et le r\u00e9c\u00e9piss\u00e9 postal jusqu&rsquo;\u00e0 r\u00e9ception de l&rsquo;accus\u00e9 de r\u00e9ception.<\/p>\n<p>Lorsque la d\u00e9claration est effectu\u00e9e par voie \u00e9lectronique par un employeur relevant du r\u00e9gime g\u00e9n\u00e9ral de s\u00e9curit\u00e9 sociale pr\u00e9alablement inscrit \u00e0 un service d&rsquo;authentification, la formalit\u00e9 est r\u00e9put\u00e9e accomplie au moyen de la fourniture du num\u00e9ro d&rsquo;identification de l&rsquo;\u00e9tablissement employeur, du num\u00e9ro national d&rsquo;identification du salari\u00e9 s&rsquo;il est d\u00e9j\u00e0 immatricul\u00e9 \u00e0 la s\u00e9curit\u00e9 sociale et s&rsquo;il a d\u00e9j\u00e0 fait l&rsquo;objet d&rsquo;une d\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche dans un d\u00e9lai de 14 mois tout en indiquant les date et heure d&#8217;embauche ainsi que les nature, dur\u00e9e du contrat ainsi que dur\u00e9e de la p\u00e9riode d&rsquo;essai \u00e9ventuelle pour les contrats \u00e0 dur\u00e9e ind\u00e9termin\u00e9e et les contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e dont le terme ou la dur\u00e9e minimale exc\u00e8de six mois.<\/p>\n<p>Lors de l&#8217;embauche du salari\u00e9, l&#8217;employeur lui fournit une copie de la d\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche ou de l&rsquo;accus\u00e9 de r\u00e9ception.<\/p>\n<p>Cette obligation de remise est consid\u00e9r\u00e9e comme satisfaite d\u00e8s lors que le salari\u00e9 dispose d&rsquo;un contrat de travail \u00e9crit, accompagn\u00e9 de la mention de l&rsquo;organisme destinataire de la d\u00e9claration.<\/p>\n<p>Le non-respect de l&rsquo;obligation de d\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche entra\u00eene une p\u00e9nalit\u00e9 dont le montant est \u00e9gal \u00e0 trois cents fois le taux horaire du minimum garanti.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Depuis le 1er ao\u00fbt 2011, la D\u00e9claration Unique d&rsquo;Embauche (DUE) et la D\u00e9claration Pr\u00e9alable \u00e0 l&rsquo;Embauche (DPAE) ont fusionn\u00e9.
