{"id":14916,"date":"2020-04-30T10:19:06","date_gmt":"2020-04-30T08:19:06","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=14916"},"modified":"2020-05-05T09:48:46","modified_gmt":"2020-05-05T07:48:46","slug":"crise-sanitaire-covid-19-conges-payes","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2020\/04\/30\/crise-sanitaire-covid-19-conges-payes\/","title":{"rendered":"Crise sanitaire : les r\u00e8gles d\u00e9rogatoires relatives aux cong\u00e9s pay\u00e9s"},"content":{"rendered":"\n<p>Ces d\u00e9rogations doivent \u00eatre pr\u00e9vues par un accord collectif d\u2019entreprise ou de branche.<\/p>\n\n\n\n<p>L\u2019entreprise peut \u00e0 cet \u00e9gard imposer les cong\u00e9s pay\u00e9s dans la limite de 6 jours ouvrables (5 jours ouvr\u00e9s)<\/p>\n\n\n\n<p>La p\u00e9riode d\u00e9rogatoire s\u2019\u00e9tend jusqu\u2019au 31\/12\/2020.<\/p>\n\n\n\n<p>Cette facult\u00e9 permet \u00e9galement \u00e0 l\u2019entreprise de fixer les cong\u00e9s pay\u00e9s sans le respect du d\u00e9lai de pr\u00e9venance conventionnel ou \u00e0 d\u00e9faut l\u00e9gal d\u2019un mois.<\/p>\n\n\n\n<p>Le d\u00e9lai ne peut \u00eatre inf\u00e9rieur \u00e0 un jour franc.<\/p>\n\n\n\n<p>La crise sanitaire actuelle est \u00e9galement consid\u00e9r\u00e9e comme \u00e9tant une circonstance exceptionnelle fix\u00e9e \u00e0 l\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000033020765&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20160810\">art L 3141-15 du code du travail<\/a> (Q\/R du 9 mars 2020 ministre des affaires sociales). <\/p>\n\n\n\n<h2 style=\"color:#d10016;\"><strong>Fractionnement des cong\u00e9s pay\u00e9s<\/strong><\/h2>\n\n\n\n<p>En principe, en l\u2019absence d\u2019accord d\u2019entreprise, ou \u00e0 d\u00e9faut de branche, le cong\u00e9 principal d\u2019une dur\u00e9e sup\u00e9rieure \u00e0 12 jours ouvrables et au plus \u00e9gale \u00e0 24 jours, peut \u00eatre fractionn\u00e9 par l\u2019employeur avec l\u2019accord du salari\u00e9.<\/p>\n\n\n\n<p>Une fraction d\u2019au moins 12 jours ouvrables doit-\u00eatre prise, en continu, entre le 1er mai et le 31 octobre et ce sont les jours, du cong\u00e9 principal, restant dus qui peuvent donner lieu \u00e0 des jours de cong\u00e9s suppl\u00e9mentaires.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000033020751&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20160810\"><em>Art L 3141-19 et 23 du code du travail<\/em><\/a><\/p>\n\n\n\n<p>L\u2019employeur peut \u00e9galement sous r\u00e9serve d\u2019un accord d\u2019entreprise ou \u00e0 d\u00e9faut de branche, fractionner les cong\u00e9s sans \u00eatre tenu de recueillir l\u2019accord du salari\u00e9.<\/p>\n\n\n\n<h2 style=\"color:#d10016;\"><strong>Cong\u00e9 simultan\u00e9<\/strong><\/h2>\n\n\n\n<p>En principe, les conjoints et les partenaires li\u00e9s par un pacte civil de solidarit\u00e9 travaillant dans une m\u00eame entreprise ont droit \u00e0 un cong\u00e9 simultan\u00e9.<br>\nL\u2019entreprise n\u2019est plus tenue d\u2019appliquer cette r\u00e8gle. Cette d\u00e9rogation est applicable jusqu\u2019au 31\/12\/2020.<\/p>\n\n\n\n<h2 style=\"color:#d10016;\"><strong>Absence d\u2019accord collectif<\/strong><\/h2>\n\n\n\n<p>En l\u2019absence d\u2019accord, l\u2019entreprise doit appliquer les dispositions de droit commun \u00e0 savoir :<br> Respecter un d\u00e9lai d\u2019un mois avant la fixation des dates de cong\u00e9s&nbsp;;<br> Ne pas modifier les dates de cong\u00e9s sauf \u00e0 respecter le d\u00e9lai d\u2019un mois&nbsp;;<br> Fractionner les cong\u00e9s avec l\u2019accord du salari\u00e9<\/p>\n\n\n\n<h2 style=\"color:#d10016;\"><strong>Dispositions sp\u00e9cifiques en mati\u00e8re de prise de repos<\/strong><\/h2>\n\n\n\n<p>L\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=JORFTEXT000041755940&amp;categorieLien=id\">ordonnance n\u00b02020-323 en date du 25\/03\/2020<\/a>, permet \u00e0 l\u2019employeur d\u2019imposer la prise ou de modifier de fa\u00e7on unilat\u00e9rale le positionnement des jours de repos du salari\u00e9.<\/p>\n\n\n\n<p>Sont concern\u00e9s&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Les jours de RTT<\/li><li>Les jours de repos des forfaits jours ;<\/li><li>Les jours de repos affect\u00e9s dans le CET.<\/li><\/ul>\n\n\n\n<p>Cette possibilit\u00e9 li\u00e9e \u00e0 la crise sanitaire du COVID-19 permet de d\u00e9roger aux dispositions des accords collectifs.<\/p>\n\n\n\n<p>Le d\u00e9lai de pr\u00e9venance \u00e0 respecter est d\u2019au moins un jour franc.<\/p>\n\n\n\n<p>La p\u00e9riode de prise des jours de repos impos\u00e9e de fa\u00e7on d\u00e9rogatoire au code du travail ne pourra exc\u00e9der le 31\/12\/2020.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Maximum de 10 jours<\/h4>\n\n\n\n<p>Le nombre de jours pouvant \u00eatre impos\u00e9 ou modifi\u00e9 dans le cadre du dispositif d\u00e9rogatoire est limit\u00e9 \u00e0 10 jours maximum.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ces d\u00e9rogations doivent \u00eatre pr\u00e9vues par un accord collectif d\u2019entreprise ou de branche.
