{"id":1533,"date":"2007-03-01T00:00:00","date_gmt":"2007-02-28T22:00:00","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/2007\/03\/chercher-a-reclasser-le-salarie-inapte-une-obligation-pour-lemployeur\/"},"modified":"2007-03-01T00:00:00","modified_gmt":"2007-02-28T22:00:00","slug":"chercher-a-reclasser-le-salarie-inapte-une-obligation-pour-lemployeur","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2007\/03\/01\/chercher-a-reclasser-le-salarie-inapte-une-obligation-pour-lemployeur\/","title":{"rendered":"Chercher \u00e0 reclasser le salari\u00e9 inapte : une obligation pour l&#039;employeur"},"content":{"rendered":"<h3>L&rsquo;histoire<\/h3>\n<p>Un salari\u00e9 a \u00e9t\u00e9 <b>d\u00e9clar\u00e9 inapte d\u00e9finitif <\/b>\u00e0 tout poste dans l&rsquo;entreprise par le m\u00e9decin du travail. <\/p>\n<p>Apr\u00e8s avoir re\u00e7u l&rsquo;avis d&rsquo;inaptitude, l&#8217;employeur a sollicit\u00e9 l&rsquo;avis du m\u00e9decin du travail qui lui a confirm\u00e9 que <b>l&rsquo;\u00e9tat de sant\u00e9 du salari\u00e9 ne permettait pas un am\u00e9nagement de son poste de travail ou un reclassement<\/b><\/p>\n<p> dans l&rsquo;entreprise.<\/p>\n<p>Il a alors<b> licenci\u00e9 le salari\u00e9 pour inaptitude sans rechercher \u00e0 le reclasser<\/b>.<\/p>\n<p>Ce dernier a saisi la juridiction prud&rsquo;homale et a demand\u00e9 des dommages et int\u00e9r\u00eats pour<b> licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/b><\/p>\n<p>\u00a0<\/p>\n<h3>Ce qu&rsquo;en disent les juges<br \/><\/h3>\n<p>Ni l&rsquo;avis du m\u00e9decin du travail ni les pr\u00e9cisions apport\u00e9es ult\u00e9rieurement par ce m\u00e9decin ne dispensent l&#8217;employeur de <b>rechercher une possibilit\u00e9 de reclassement <\/b>au sein de l&rsquo;entreprise et, le cas \u00e9ch\u00e9ant, au sein du groupe auquel l&rsquo;entreprise appartient.<\/p>\n<p>Le salari\u00e9 a droit \u00e0 des dommages et int\u00e9r\u00eats pour licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<h3>Ce qu&rsquo;il faut retenir<b><br \/><\/b><\/h3>\n<li><b>L&#8217;employeur doit rechercher \u00e0 reclasser le salari\u00e9 inapte. <\/b>Pourcela il peut mettre en oeuvre des mesures de mutation, transformationd&#8217;emploi ou d&rsquo;am\u00e9nagement du temps de travail (article L. 122-24-4 duCode du travail).<\/li>\n<li>Le fait que le m\u00e9decin du travail pr\u00e9cise que <b>son reclassement est impossible<\/b> ne dispense pas l&#8217;employeur de satisfaire \u00e0 cette obligation.<\/li>\n<li>En effet, <b>l&#8217;employeur doit rechercher \u00e0 reclasser le salari\u00e9<\/b> y compris si le m\u00e9decin du travail le d\u00e9clare inapte \u00e0 tout emploi dans l&rsquo;entreprise.<\/li>\n<li>Notez que si l&#8217;employeur ne respecte pas cette obligation avant de licencier le salari\u00e9, ce dernier a droit \u00e0 des <b>dommages et int\u00e9r\u00eats pour licenciement sans cause r\u00e9elle et s\u00e9rieuse<\/b>.<\/li>\n<p>Sources : Arr\u00eat de la Chambre sociale de la Cour de cassation du 28 mars 2007 n\u00b0 06-40098, juritravail.com<\/p>\n","protected":false},"excerpt":{"rendered":"<p>L&rsquo;histoire Un salari\u00e9 a \u00e9t\u00e9 d\u00e9clar\u00e9 inapte d\u00e9finitif \u00e0 tout poste dans l&rsquo;entreprise par le m\u00e9decin du travail.
