{"id":1552,"date":"2009-01-14T00:00:00","date_gmt":"2009-01-13T22:00:00","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/2009\/01\/la-reglementation-du-chomage-partiel\/"},"modified":"2009-01-14T00:00:00","modified_gmt":"2009-01-13T22:00:00","slug":"la-reglementation-du-chomage-partiel","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2009\/01\/14\/la-reglementation-du-chomage-partiel\/","title":{"rendered":"La r\u00e9glementation du ch\u00f4mage partiel"},"content":{"rendered":"<p>Si pour des raisons \u00e9conomiques certaines entreprises doivent <span style=\"font-weight: bold;\">r\u00e9duireleur activit\u00e9<\/span>, par la fermeture temporaire d&rsquo;\u00e9tablissement ou lar\u00e9duction de l&rsquo;horaire de travail, <span style=\"font-weight: bold;\">l&rsquo;\u00c9tat prend en charge l&rsquo;allocationsp\u00e9cifique de ch\u00f4mage partiel de 2,44 &euro; par heure de travail dans lesentreprises de moins de 250 salari\u00e9s (et de 2,13 &euro; dans les autres),<\/span> \u00e9ventuellement compl\u00e9t\u00e9e par une indemnit\u00e9 vers\u00e9e par l&#8217;employeur etfix\u00e9e par accord.<\/p>\n<p>Le montant total per\u00e7u par chaque salari\u00e9 doit atteindre <span style=\"font-weight: bold;\">au moins 50 % de sa r\u00e9mun\u00e9ration brute, avec un minimum de 4,42 &euro; par heure (soit 51 % du Smic actuel).<\/span><\/p>\n<p>Si la situation perdure, les salari\u00e9s dont le contrat de travail est suspendu, sans \u00eatre licenci\u00e9s (il s&rsquo;agit de \u00ab ch\u00f4mage partiel total \u00bb), peuvent b\u00e9n\u00e9ficier de <span style=\"font-weight: bold;\">l&rsquo;allocation d&rsquo;aide de retour \u00e0 l&#8217;emploi.<\/span><br style=\"font-weight: bold;\" \/><br \/>La dur\u00e9e cons\u00e9cutive de l&rsquo;arr\u00eat de travail qui sert de d\u00e9clenchement \u00e0 l&rsquo;indemnisation par l&rsquo;Assedic passe <span style=\"font-weight: bold;\">de 4 \u00e0 6 semaines, <\/span>ce qui permet aux salari\u00e9s de percevoir l&rsquo;allocation de ch\u00f4mage partiel pendant deux semaines suppl\u00e9mentaires.<\/p>\n<p>L&#8217;employeur verse <span style=\"font-weight: bold;\">la totalit\u00e9 des indemnit\u00e9s \u00e0 l&rsquo;\u00e9ch\u00e9ance normale de la paie, <\/span>puis se fait rembourser par l&rsquo;\u00c9tat le montant de l&rsquo;allocation sp\u00e9cifique, <span style=\"font-weight: bold;\">dans la limite de 800 heures par salari\u00e9 et par an<\/span> (au lieu de 600 heures auparavant).<\/p>\n<p>Ce contingent annuel est fix\u00e9 \u00e0 <span style=\"font-weight: bold;\">1 000 heures dans le textile et l&rsquo;habillement, dans l&rsquo;industrie automobile et ses sous-traitants<\/span>, qui r\u00e9alisent avec elle au minimum 50 % de leur chiffre d&rsquo;affaires, ainsi que pour le commerce de v\u00e9hicules automobiles.
