Ildoit comporter des mentions obligatoires concernant l&rsquo;identificationdes salari\u00e9s, les dates d&#8217;embauche et de d\u00e9part, les contrats detravail. Le registre doit \u00eatre conserv\u00e9 dans l&rsquo;entreprise cinq ansapr\u00e8s le d\u00e9part du salari\u00e9. Toute infraction est punie d&rsquo;une sanctionp\u00e9nale.<\/p>\n<p>Aucune forme sp\u00e9cifique n&rsquo;est impos\u00e9e \u00e0 l&#8217;employeur pour la tenue du registre unique du personnel.<\/p>\n<h3>Les employeurs concern\u00e9s<\/h3>\n<p>Toutemployeur est tenu de tenir un registre unique du personnel. Seulesexceptions : les particuliers employeurs et les associations ayantrecours au ch\u00e8que emploi associatif.<\/p>\n<p>Pour quelssalari\u00e9s&nbsp;? Le registre unique du personnel concerne tous les salari\u00e9sde l&rsquo;entreprise, y compris ceux mis \u00e0 disposition par les entreprisesde travail temporaire.<\/p>\n<p>Comme tout salari\u00e9, le travailleur \u00e9tranger doit figurer dans leregistre unique du personnel. Pour conna\u00eetre les autres obligations\u00e0ce sujet, voir l&#8217;embauche d&rsquo;un \u00e9tranger.<\/p>\n<h3>Les obligations de l&#8217;employeur<\/h3>\n<p>Unregistre par \u00e9tablissement La tenue du registre du personnel estobligatoire au niveau de l&rsquo;\u00e9tablissement. Cons\u00e9quence : si l&rsquo;entreprisecomporte plusieurs \u00e9tablissement, l&#8217;employeur doit tenir dans chacund&rsquo;eux un registre du personnel.<\/p>\n<p>Des mentions obligatoires Les mentions port\u00e9es dans le registre permettent d&rsquo;identifier le salari\u00e9 :<\/p>\n<li> nom et pr\u00e9nom,<\/li>\n<li> nationalit\u00e9,<\/li>\n<li> date de naissance,<\/li>\n<li> sexe,<\/li>\n<li> emploi,<\/li>\n<li> qualification,<\/li>\n<li> dates d&rsquo;entr\u00e9e et de sortie de l&rsquo;\u00e9tablissement.<\/li>\n<p>Par ailleurs, si le salari\u00e9 est embauch\u00e9 comme \u00a0\u00bb apprenti \u00ab\u00a0, en \u00ab\u00a0contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e \u00ab\u00a0, comme \u00a0\u00bb travailleur \u00e0 temps partiel \u00ab\u00a0,comme \u00a0\u00bb travailleur temporaire \u00a0\u00bb ou encore \u00a0\u00bb mis \u00e0 disposition par ungroupement d&#8217;employeurs \u00ab\u00a0, la pr\u00e9cision correspondant \u00e0 cette situation.<\/p>\n<p>Le personnel doit \u00eatre inscrit en respectant l&rsquo;ordre chronologique d&#8217;embauchage et de fa\u00e7on ind\u00e9l\u00e9bile.<\/p>\n<h3>La forme du registre unique du personnel<\/h3>\n<p>Aucuneforme particuli\u00e8re n&rsquo;est impos\u00e9e pour la tenue du registre. Sil&#8217;employeur choisit d&rsquo;utiliser d&rsquo;autres moyens que le support papier -informatiques notamment &#8211; ceux-ci doivent offrir des garanties decontr\u00f4le \u00e9quivalentes au support papier.<\/p>\n<p> Les traitementsinformatis\u00e9s des registres obligatoires (notamment du registre uniquedu personnel) sont dispens\u00e9s de d\u00e9claration aupr\u00e8s de la CommissionNationale Informatique et Libert\u00e9s (CNIL) lorsqu&rsquo;ils r\u00e9pondent auxconditions fix\u00e9es par la D\u00e9lib\u00e9ration CNIL n\u00b0 2004-097 du 9 d\u00e9cembre2004.<\/p>\n<h3>Les sanctions en cas d&rsquo;infraction<\/h3>\n<p>Encas de contr\u00f4le, le registre du personnel doit pouvoir \u00eatre pr\u00e9sent\u00e9.Registre absent, mentions erron\u00e9es ou incompl\u00e8tes, la sanction estidentique : l&#8217;employeur aura \u00e0 s&rsquo;acquitter d&rsquo;une amende d&rsquo;un montantpouvant aller jusqu&rsquo; \u00e0 750 &euro;.<\/p>\n<p>Source : Minist\u00e8re de l&rsquo;Emploi, de la coh\u00e9sion sociale et du logement.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Synth\u00e8se Etablipar l&#8217;employeur, le registre du personnel permet de s&rsquo;assurer de latransparence des emplois dans chaque \u00e9tablissement de l&rsquo;entreprise.
