Cet accord doit e\u0302tre de\u0301pose\u0301 sur la plateforme \u00ab\u00a0Te\u0301le\u0301accords\u00a0\u00bb dans les de\u0301lais requis. Si l&rsquo;accord de branche comporte des options que l&rsquo;entreprise souhaite exercer (ex.&nbsp;: formule de calcul alternative, modalite\u0301s de re\u0301partition diffe\u0301rentes), l&rsquo;accord de\u0301pose\u0301 doit indiquer les options retenues par l&rsquo;entreprise mais peut ne contenir que les clauses re\u0301sultant de ces choix.<\/p>\n\n<p><em><a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006902953&#038;cidTexte=LEGITEXT000006072050&#038;dateTexte=20080501\">Articles D. 3312-1<\/a> et <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072050&#038;idArticle=LEGIARTI000019870468\">D. 3322-1 du Code du travail<\/a><\/em><\/p>\n\n<p>La branche peut e\u0301galement proposer un accord d&rsquo;inte\u0301ressement ou de participation type aux entreprises de moins de 50 salarie\u0301s.<\/p>\n<p><em><a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072050&#038;idArticle=LEGIARTI000033012309\">Article L. 2232-10-1 du Code du travail<\/a><\/em><\/p>\n\n<p>Pour appliquer cet accord type, l&rsquo;entreprise doit de\u0301poser un document unilate\u0301ral spe\u0301cifiant son adhe\u0301sion a\u0300 l&rsquo;accord sur la plateforme \u00ab\u00a0Te\u0301le\u0301accords\u00a0\u00bb dans les de\u0301lais requis.<\/p>\n\n<p><em><a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006902953&#038;cidTexte=LEGITEXT000006072050&#038;dateTexte=20080501\">Articles D. 3312-1<\/a> et <a href=\"https:\/\/www.google.com\/search?client=firefox-b-ab&#038;q=L.+3322-1+du+Code+du+travail&#038;sa=X&#038;ved=2ahUKEwjLmKn797jrAhUR1BoKHUXwCYgQ7xYoAHoECAwQKg&#038;biw=1674&#038;bih=865\">D. 3322-1 du Code du travail<\/a><\/em><\/p>\n\n<h2 style=\"color:#d10016;\"><strong>Modification ou d\u00e9nonciation de l&rsquo;accord d&rsquo;int\u00e9ressement<\/strong><\/h2>\n\n<p>La de\u0301nonciation ou modification d\u2019un accord d&rsquo;inte\u0301ressement ne peut en principe se faire que par l&rsquo;ensemble des signataires et dans la me\u0302me forme que sa conclusion. L&rsquo;accord de de\u0301nonciation ou l&rsquo;avenant modificatif doit e\u0302tre de\u0301pose\u0301 sur la plateforme \u00ab\u00a0Te\u0301le\u0301accords\u00a0\u00bb.<\/p>\n\n<p>Une modification ou une de\u0301nonciation unilate\u0301rale d&rsquo;un accord d&rsquo;inte\u0301ressement n&rsquo;est par conse\u0301quent pas possible, sauf en cas de contestation de l&rsquo;administration.<\/p>\n\n<p>Destine\u0301es a\u0300 assurer une stabilite\u0301 de l&rsquo;accord pendant la dure\u0301e de son application, les conditions d&rsquo;unanimite\u0301 des parties signataires et de paralle\u0301lisme des formes exige\u0301es pour sa de\u0301nonciation ou sa modification e\u0301taient impossibles a\u0300 remplir en cas de disparition d&rsquo;une ou plusieurs des parties signataires d&rsquo;origine.<\/p>\n\n<p>Le de\u0301cret du 26 juin 2020 re\u0301sout cette difficulte\u0301. De\u0301sormais, dans ce cas de figure, l&rsquo;accord peut e\u0302tre de\u0301nonce\u0301 ou modifie\u0301 selon l&rsquo;une des modalite\u0301s de conclusion propres a\u0300 l&rsquo;accord d&rsquo;inte\u0301ressement.<\/p>\n\n<p><em><a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000018533384&#038;cidTexte=LEGITEXT000006072050\">Article D. 3313-5 du Code du travail<\/a><\/em><\/p>\n\n<p>N. B.&nbsp;: les modalite\u0301s de conclusion de droit commun d&rsquo;un dispositif d&rsquo;inte\u0301ressement sont l&rsquo;accord collectif d&rsquo;entreprise, l&rsquo;accord avec les repre\u0301sentants de syndicats, l&rsquo;accord avec le CSE ou la ratification d&rsquo;un projet par le personnel. Le recours a\u0300 la de\u0301cision unilate\u0301rale de l&#8217;employeur (DUE), modalite\u0301 ouverte exclusivement aux entreprises de moins de 11 salarie\u0301s sans de\u0301le\u0301gue\u0301s syndicaux ni CSE, est exclu.<\/p>\n\n<p>Le paralle\u0301lisme des formes n&rsquo;est plus requis dans ce cas de figure. Toutefois, pour e\u0302tre applicable a\u0300 l&rsquo;exercice en cours, la de\u0301nonciation de l&rsquo;accord d&rsquo;inte\u0301ressement ou du document unilate\u0301ral (en cas d&rsquo;application d&rsquo;un accord type de branche) doit e\u0302tre de\u0301pose\u0301e dans les de\u0301lais pre\u0301vus pour le de\u0301po\u0302t de l&rsquo;accord initial, soit dans les 15 jours a\u0300 compter de la date limite de conclusion de l&rsquo;accord (avant le premier jour de la seconde moitie\u0301 de la pe\u0301riode de calcul de l&rsquo;inte\u0301ressement).<\/p>\n\n<h2 style=\"color:#d10016;\"><strong>Autres mesures du d\u00e9cret<\/strong><\/h2>\n\n<p>Les sommes attribue\u0301es au salarie\u0301 en application d&rsquo;un accord d&rsquo;inte\u0301ressement et\/ou de participation font l&rsquo;objet d&rsquo;une fiche distincte du bulletin de paie, fiche dont la remise peut e\u0302tre effectue\u0301e par voie e\u0301lectronique, sauf opposition du salarie\u0301.
