Il en est de m\u00eamelorsque le salari\u00e9 a accept\u00e9 la promesse d&#8217;embauche.<\/p>\n<h4>Rupture de la promesse d&#8217;embauche : les garanties financi\u00e8res pour le salari\u00e9<b><br \/><\/b><\/h4>\n<p><b>1. Dommages et int\u00e9r\u00eats<br \/><\/b><\/p>\n<p>L&#8217;employeur qui ne tient pas son engagement peut \u00eatre condamn\u00e9 par leconseil des prud&rsquo;hommes \u00e0 verser au salari\u00e9 des dommages et int\u00e9r\u00eats enr\u00e9paration du pr\u00e9judice subi par celui-ci. Le salari\u00e9 n&rsquo;a pas \u00e0d\u00e9montrer en quoi cette rupture a entra\u00een\u00e9 pour lui un dommage. Il doitsimplement prouver l&rsquo;existence d&rsquo;une proposition ferme et pr\u00e9cise.<\/p>\n<p>Attention ! L&#8217;employeur a la possibilit\u00e9 d&rsquo;int\u00e9grer dans la promessed&#8217;embauche une clause de r\u00e9tractation, ce qui lui permet de revenir sursa d\u00e9cision ou de la conditionner.<\/p>\n<p><b>2. Dommages et int\u00e9r\u00eats et indemnit\u00e9 compensatrice de pr\u00e9avis<br \/><\/b><\/p>\n<p> Une fois que le salari\u00e9 a accept\u00e9 la promesse d&#8217;embauche, on consid\u00e8re qu&rsquo;il y a conclusion d&rsquo;un contrat de travail.<\/p>\n<p>Ainsi, la rupture de la promesse d&#8217;embauche par l&#8217;employeur s&rsquo;analyseen un licenciement, m\u00eame si l&rsquo;ex\u00e9cution de ce contrat de travail n&rsquo;estpas encore commenc\u00e9e. Le salari\u00e9 a droit en plus des dommages etint\u00e9r\u00eats \u00e0 une indemnit\u00e9 compensatrice de pr\u00e9avis.<\/p>\n<p>Notez que la condamnation de l&#8217;employeur peut \u00eatre plus importante.
