Or, leur employeur ne consid\u00e9rait pas cette pause comme\u00e9tant du temps de travail effectif. Les salari\u00e9s contestaient cetted\u00e9cision en pr\u00e9cisant que durant leur temps de pause ils ne pouvaientquitter l&rsquo;enceinte de l&rsquo;entreprise sans autorisation de l&#8217;employeur.<\/p>\n<h3>Ce qu&rsquo;en disent les juges :<\/h3>\n<p>Lesjuges rappellent que la p\u00e9riode consacr\u00e9e \u00e0 la pause n&rsquo;est en principepas consid\u00e9r\u00e9e comme du temps de travail effectif. Toutefois, ilspr\u00e9cisent \u00e9galement que ceci peut \u00eatre le cas si le salari\u00e9 est, durantses pauses, \u00e0 la disposition de l&#8217;employeur pr\u00eat \u00e0 se conformer \u00e0 sesdirectives sans pouvoir vaquer librement \u00e0 des occupations personnelles.<\/p>\n<p>Dans le cas pr\u00e9sent, les juges ont constat\u00e9 que les salari\u00e9s prenaientleur pause dans un local distinct des ateliers et que l&#8217;employeur neles soumettait \u00e0 aucune intervention. Par cons\u00e9quent, les salari\u00e9s nese tenaient pas \u00e0 la disposition de l&#8217;employeur et pouvaient vaquer \u00e0des occupations personnelles.<\/p>\n<h3>Ce qu&rsquo;il faut retenir :<\/h3>\n<li>Le temps de pause ne correspond pas \u00e0 du temps de travail effectif<\/li>\n<li>En revanche, si lors des pauses le salari\u00e9 se tient \u00e0 la dispositionde l&#8217;employeur en se conformant \u00e0 ses directives et sans pouvoir vaquer\u00e0 des occupations personnelles, ce temps de pause sera consid\u00e9r\u00e9 commedu temps de travail effectif.<\/li>\n<li>Dans le cas contraire, le temps de pause ne peut \u00eatre consid\u00e9r\u00e9 comme du temps de travail effectif :<\/li>\n<li> M\u00eame si le salari\u00e9 ne peut quitter l&rsquo;enceinte de l&rsquo;entreprise.<\/li>\n<li>D&rsquo;autant plus si les salari\u00e9s prennent leur temps de pause dans unlocal distinct de celui dans lequel il travaille.<\/li>\n<p> Source : Arr\u00eat de la Chambre Sociale de la Cour de cassation du 3 novembre 2005 &#8211; juritravail.com<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Les faits : Lessalari\u00e9s de la soci\u00e9t\u00e9 b\u00e9n\u00e9ficiaient d&rsquo;une demi-heure de pause lors deleur service.
