Quelques mois apr\u00e8s sonembauche, l&#8217;employeur modifie son horaire de travail, \u00e0 savoir qu&rsquo;ildoit d\u00e9sormais travailler entre 19H et 5H15 avec un temps de repos de0h45 \u00e0 1H30.<\/p>\n<p>A la suite du refus du salari\u00e9, l&#8217;employeur lui a notifi\u00e9 la rupture deson contrat de travail pour faute grave, en raison de son abandon deposte. Contestant le bien-fond\u00e9 de cette rupture, le salari\u00e9 a saisi lajuridiction prud&rsquo;homale en vue d&rsquo;obtenir le paiement de diversesindemnit\u00e9s.<\/p>\n<p>La Cour d&rsquo;appel le d\u00e9boute de son action en retenant que l&#8217;employeurpouvait dans le cadre de son pouvoir de direction et d&rsquo;organisation del&rsquo;entreprise, proc\u00e9der \u00e0 de simples modifications des conditions detravail des salari\u00e9s. et que l&rsquo;abandon de poste \u00e9tait constitutif d&rsquo;unefaute grave.<\/p>\n<p>L&rsquo;arr\u00eat est cass\u00e9 par la Cour de cassation.
