{"id":1833,"date":"2009-04-08T00:00:00","date_gmt":"2009-04-07T22:00:00","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/2009\/04\/du-nouveau-en-matiere-de-mise-a-pied-conservatoire\/"},"modified":"2009-04-08T00:00:00","modified_gmt":"2009-04-07T22:00:00","slug":"du-nouveau-en-matiere-de-mise-a-pied-conservatoire","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2009\/04\/08\/du-nouveau-en-matiere-de-mise-a-pied-conservatoire\/","title":{"rendered":"Du nouveau en mati\u00e8re de mise \u00e0 pied conservatoire"},"content":{"rendered":"<p>Convoqu\u00e9 pour <span style=\"font-weight: bold;\">un licenciement pour faute grave,<\/span> mon employeur peut-il prononcer <span style=\"font-weight: bold;\">ma mise \u00e0 pied conservatoire pour 3 jours&nbsp;? <\/span>Un salari\u00e9, employ\u00e9 comme repr\u00e9sentant, est convoqu\u00e9 \u00e0 un entretien pr\u00e9alable de licenciement avec mise \u00e0 pied conservatoire de trois jours. <\/p>\n<p>Il est ensuite<span style=\"font-weight: bold;\"> licenci\u00e9 pour faute grave.<\/span> Le salari\u00e9 estime avoir \u00e9t\u00e9 <span style=\"font-weight: bold;\">sanctionn\u00e9 deux fois pour le m\u00eame fait<\/span>, il saisit le juge.<\/p>\n<p>La mise \u00e0 pied conservatoire est <span style=\"font-weight: bold;\">une mesure d&rsquo;attente qui pr\u00e9c\u00e8de <\/span>un licenciement pour faute grave ou lourde<span style=\"font-weight: bold;\">\u00a0<\/span><br \/>\u00a0du salari\u00e9. <\/p>\n<p>Cela permet \u00e0 l&#8217;employeur de <span style=\"font-weight: bold;\">suspendre temporairement l&rsquo;activit\u00e9 du salari\u00e9<\/span>, qu&rsquo;il consid\u00e8re fautif, pendant la dur\u00e9e de la proc\u00e9dure de licenciement.<\/p>\n<p>La mise \u00e0 pied conservatoire est \u00e0 <span style=\"font-weight: bold;\">dur\u00e9e ind\u00e9termin\u00e9e<\/span> contrairement \u00e0 la mise \u00e0 pied disciplinaire, qui est une sanction inflig\u00e9e au salari\u00e9 pour une dur\u00e9e d\u00e9termin\u00e9e.<\/p>\n<p>D\u00e8s lors, une mise \u00e0 pied conservatoire est obligatoirement <span style=\"font-weight: bold;\">requalifi\u00e9e en mise \u00e0 pied disciplinaire<\/span> quand elle mentionne une dur\u00e9e (<span style=\"font-style: italic;\">arr\u00eat de la Chambre sociale de la Cour de Cassation du 12 f\u00e9vrier 2003. N\u00b0: 00-46433<\/span>).<\/p>\n<p>Dans cette affaire,<span style=\"font-weight: bold;\"> les juges ont consid\u00e9r\u00e9 que m\u00eame si la mise \u00e0 pied conservatoire avait \u00e9t\u00e9 prononc\u00e9e pour une dur\u00e9e d\u00e9termin\u00e9e, elle conservait une nature conservatoire<\/span> car elle avait \u00e9t\u00e9 prononc\u00e9e en m\u00eame temps que l&rsquo;engagement de la proc\u00e9dure de licenciement.<\/p>\n<p><span style=\"text-decoration: underline; font-weight: bold;\">A savoir :<\/span><br \/>Cet arr\u00eat est important car<span style=\"font-weight: bold;\"> il ne sanctionne plus l&#8217;employeur qui aurait indiqu\u00e9 une dur\u00e9e dans la mise \u00e0 pied conservatoire.<\/p>\n<p>En r\u00e9sum\u00e9 : <br \/><\/span>   <\/p>\n<li><span style=\"font-weight: bold;\">Avant : <\/span>Mise \u00e0 pied conservatoire avec dur\u00e9e + licenciement = 2 sanctions = licenciement injustifi\u00e9 donc droit \u00e0 indemnit\u00e9s.<\/li>\n<li>Aujourd&rsquo;hui : Mise \u00e0 pied conservatoire avec dur\u00e9e + licenciement = licenciement valable<\/li>\n<p> <span style=\"font-style: italic;\"><br \/>Source : Arr\u00eat de la Chambre sociale de la Cour de cassation du 18 mars 2009.
