{"id":1834,"date":"2009-04-08T00:00:00","date_gmt":"2009-04-07T22:00:00","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/2009\/04\/faute-grave-et-refus-dassister-a-une-formation\/"},"modified":"2009-04-08T00:00:00","modified_gmt":"2009-04-07T22:00:00","slug":"faute-grave-et-refus-dassister-a-une-formation","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2009\/04\/08\/faute-grave-et-refus-dassister-a-une-formation\/","title":{"rendered":"Faute grave et refus d&#039;assister \u00e0 une formation"},"content":{"rendered":"<p>L&rsquo;affaire : un salari\u00e9 employ\u00e9 en qualit\u00e9 de conducteur receveur a \u00e9t\u00e9<span style=\"font-weight: bold;\"> licenci\u00e9 pour faute grave<\/span> suite \u00e0 sa mise en cause dans deux accidents de la circulation et \u00e0 <span style=\"font-weight: bold;\">son refus de participer \u00e0 une formation<\/span> sur la s\u00e9curit\u00e9 routi\u00e8re demand\u00e9e par son employeur. <span style=\"font-weight: bold;\">Le salari\u00e9 conteste son licenciement <\/span>et saisit le Conseil de prud&rsquo;hommes. <span style=\"font-weight: bold;\">Le licenciement pour faute grave \u00e9tait-il justifi\u00e9&nbsp;?<\/span><\/p>\n<h3>Ce qu&rsquo;il faut retenir<\/h3>\n<p>L&#8217;employeur est tenu <span style=\"font-weight: bold;\">d&rsquo;assurer<\/span> la formation<span style=\"font-weight: bold;\"> des salari\u00e9s<\/span>, notamment afin de les adapter \u00e0 leur poste de travail.<\/p>\n<p><span style=\"font-weight: bold;\">Le refus du salari\u00e9 de participer \u00e0 cette formation peut justifier <\/span><span style=\"font-weight: bold;\">un licenciement<\/span> d\u00e8s lors que cette formation est organis\u00e9e dans l&rsquo;int\u00e9r\u00eat de l&rsquo;entreprise et que le salari\u00e9 ne pr\u00e9sente pas de motif de refus l\u00e9gitime (arr\u00eat de la Chambre sociale de la Cour de cassation du 5 d\u00e9cembre 2007).<\/p>\n<p>Dans cette affaire, les juges ont constat\u00e9 que le salari\u00e9 avait \u00e9t\u00e9 responsable de deux accidents de la circulation, intervenus successivement le m\u00eame mois, et n&rsquo;avait, sans raison valable, pas assist\u00e9 \u00e0 une formation sur la s\u00e9curit\u00e9 routi\u00e8re.<\/p>\n<p>Les juges consid\u00e8rent que <span style=\"font-weight: bold;\">ces faits justifient le <\/span>licenciement pour faute grave<span style=\"font-weight: bold;\"> du salari\u00e9.<\/span><br style=\"font-weight: bold;\" \/><\/p>\n<h3>Pour aller plus loin :<\/h3>\n<p>Dans certains cas, l&#8217;employeur est dans l&rsquo;obligation d&rsquo;organiser la formation de ses salari\u00e9s ; le salari\u00e9 a alors le devoir de suivre les formations propos\u00e9es.<\/p>\n<p>Tel est le cas :   <\/p>\n<li>en vue <span style=\"font-weight: bold;\">d&rsquo;assurer l&rsquo;adaptation des salari\u00e9s \u00e0 leur poste de travail <\/span>et le maintien de leur capacit\u00e9 \u00e0 occuper un emploi, au regard de l&rsquo;\u00e9volution des emplois, des technologies et des organisations ;<\/li>\n<li><span style=\"font-weight: bold;\">lors d&rsquo;une suppression d&#8217;emploi, <\/span>l&rsquo;obligation de reclassement des salari\u00e9s s&rsquo;accompagne de celle visant \u00e0 assurer leur adaptation au nouvel emploi, par une formation ad\u00e9quate et suffisante ;<\/li>\n<li>lorsqu&rsquo;un accord ou la convention collective applicable \u00e0 l&rsquo;entreprise pr\u00e9voit des<span style=\"font-weight: bold;\"> p\u00e9riodes de formation obligatoires ;<\/span><\/li>\n<li>si le contrat de travail du salari\u00e9 contient <span style=\"font-weight: bold;\">l&rsquo;engagement de l&#8217;employeur de le former.<\/span><\/li>\n<li><span style=\"font-weight: bold;\"><br \/><\/span><\/li>\n<p> <span style=\"font-style: italic;\">Source : Arr\u00eat de la Chambre sociale de la Cour de cassation du 27 janvier 2009, n\u00b0 de pourvoi 07-43955<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>L&rsquo;affaire : un salari\u00e9 employ\u00e9 en qualit\u00e9 de conducteur receveur a \u00e9t\u00e9 licenci\u00e9 pour faute grave suite \u00e0 sa mise en cause dans deux accidents de la circulation et \u00e0 son refus de participer \u00e0 une formation sur la s\u00e9curit\u00e9 routi\u00e8re demand\u00e9e par son employeur.
