{"id":1840,"date":"2009-12-02T00:00:00","date_gmt":"2009-12-01T22:00:00","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/2009\/12\/caracterisation-du-harcelement-moral\/"},"modified":"2009-12-02T00:00:00","modified_gmt":"2009-12-01T22:00:00","slug":"caracterisation-du-harcelement-moral","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2009\/12\/02\/caracterisation-du-harcelement-moral\/","title":{"rendered":"Caract\u00e9risation du harc\u00e8lement moral"},"content":{"rendered":"\n<p>La Cour decassation rappelle que \u00ab peuvent caract\u00e9riser un harc\u00e8lement moral les m\u00e9thodesde gestion mises en oeuvre par un sup\u00e9rieur hi\u00e9rarchique d\u00e8s lors qu&rsquo;elles semanifestent pour un salari\u00e9 d\u00e9termin\u00e9 par des agissements r\u00e9p\u00e9t\u00e9s ayant pourobjet ou pour effet d&rsquo;entra\u00eener une d\u00e9gradation des conditions de travailsusceptibles de porter atteinte \u00e0 ses droits et \u00e0 sa dignit\u00e9, d&rsquo;alt\u00e9rer sasant\u00e9 physique ou mentale ou de compromettre son avenir professionnel \u00bb&#8230;<\/p>\n<p>En l&rsquo;esp\u00e8ce, lacour d&rsquo;appel a relev\u00e9 que le directeur de l&rsquo;\u00e9tablissement soumettait lessalari\u00e9s \u00e0 une pression continuelle, des reproches incessants, des ordres etcontre-ordres dans l&rsquo;intention de diviser l&rsquo;\u00e9quipe se traduisant par la mise \u00e0l&rsquo;\u00e9cart du salari\u00e9, un m\u00e9pris affich\u00e9 \u00e0 son \u00e9gard et une absence de dialoguecaract\u00e9ris\u00e9e par une communication par l&rsquo;interm\u00e9diaire d&rsquo;un tableau, ayantentra\u00een\u00e9 un \u00e9tat tr\u00e8s d\u00e9pressif.
