{"id":1842,"date":"2009-12-02T00:00:00","date_gmt":"2009-12-01T22:00:00","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/2009\/12\/stages-en-entreprise-convention-obligatoire\/"},"modified":"2009-12-02T00:00:00","modified_gmt":"2009-12-01T22:00:00","slug":"stages-en-entreprise-convention-obligatoire","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2009\/12\/02\/stages-en-entreprise-convention-obligatoire\/","title":{"rendered":"Stages en entreprise : convention obligatoire"},"content":{"rendered":"<p>La loi du 24novembre 2009 relative \u00e0 l&rsquo;orientation et \u00e0 la formation professionnelle toutau long de la vie interdit tout stage en entreprises qui ne serait pas r\u00e9alis\u00e9via <span style=\"font-weight: bold;\">une convention conclue avec une universit\u00e9, un \u00e9tablissement d&rsquo;enseignementou de formation. <\/span>Sont concern\u00e9s par cette mesure : <\/p>\n<li>tous les \u00e9tudiants ou les \u00e9l\u00e8ves des \u00e9tablissements d&rsquo;enseignement technique ; <\/li>\n<li>tous les \u00e9l\u00e8ves des \u00e9tablissements d&rsquo;enseignement secondaire ou d&rsquo;enseignementsp\u00e9cialis\u00e9 et les \u00e9tudiants autres que ceux vis\u00e9s ci-dessus ;<\/li>\n<li>et toutes lespersonnes, non mentionn\u00e9es ci-dessus, qui effectuent, dans un organisme publicou priv\u00e9, <span style=\"font-weight: bold;\">un stage d&rsquo;initiation, de formation ou de compl\u00e9ment de formationprofessionnelle ne faisant pas l&rsquo;objet d&rsquo;un contrat de travail<\/span> et n&rsquo;entrant pasdans le cadre de la formation professionnelle continue.<\/li>\n<p>En effet,l&rsquo;article 30 de la loi impose que les stages en entreprise ne relevant ni desdispositions concernant les jeunes travailleurs, ni de la formationprofessionnelle continue, fassent l&rsquo;objet entre le stagiaire, l&rsquo;entreprised&rsquo;accueil et l&rsquo;\u00e9tablissement d&rsquo;enseignement d&rsquo;une <span style=\"font-weight: bold;\">convention type.<\/span><\/p>\n<p>Ces stages doiventd\u00e9sormais \u00eatre int\u00e9gr\u00e9s \u00e0 <span style=\"font-weight: bold;\">un cursus p\u00e9dagogique<\/span>, selon des modalit\u00e9s qui sontd\u00e9finies par le d\u00e9cret n\u00b02008-96 du 31 janvier 2008 relatif \u00e0 la gratification et au suivi des stages en entreprise.<\/p>\n<p>En outre, lorsquela dur\u00e9e du stage est sup\u00e9rieure \u00e0 <span style=\"font-weight: bold;\">2 mois cons\u00e9cutifs<\/span> (contre 3 moispr\u00e9c\u00e9demment), celui-ci doit faire l&rsquo;objet d&rsquo;une <span style=\"font-weight: bold;\">gratification<\/span> dont le montantpeut \u00eatre fix\u00e9 par convention de branche ou par accord professionnel \u00e9tendu. <\/p>\n<p>Ad\u00e9faut, ce montant est au moins \u00e9gal \u00e0 <span style=\"font-weight: bold;\">12,5% du plafond horaire de la s\u00e9curit\u00e9sociale<\/span>, soit 2,63 euros en 2009, ce qui correspond \u00e0 <span style=\"font-weight: bold;\">398,13 euros par mois<\/span>pour un temps plein.
