La salari\u00e9e avaitpass\u00e9 une visite m\u00e9dicale d&#8217;embauche un mois apr\u00e8s le d\u00e9but de soncontrat.<\/p>\n<p>Or, <b>lam\u00e9decine du travail avait constat\u00e9 que la salari\u00e9e souffrait d&rsquo;unhandicap ne lui permettant pas d&rsquo;occuper le poste pour lequel elleavait \u00e9t\u00e9 engag\u00e9e<\/b>. L&#8217;employeur avait d\u00e9cid\u00e9 de <b>rompre le contrat<\/b>, mais il avait tard\u00e9 et l&rsquo;avait fait alors m\u00eame que la p\u00e9riode d&rsquo;essai avait expir\u00e9.<\/p>\n<p><b>Le licenciement a \u00e9t\u00e9 consid\u00e9r\u00e9 comme nul. <\/b>Toutefois,l&#8217;employeur estimait que Mme X l&rsquo;avait tromp\u00e9 en omettant sciemment delui parler de son handicap lors de l&rsquo;entretien d&#8217;embauche.<\/p>\n<h3>Ce qu&rsquo;en disent les juges<br \/><\/h3>\n<p>Lesrenseignements relatifs \u00e0 l&rsquo;\u00e9tat de sant\u00e9 du candidat \u00e0 un emploi nepeuvent \u00eatre confi\u00e9s qu&rsquo;au m\u00e9decin charg\u00e9 de l&rsquo;examen m\u00e9dicald&#8217;embauche. Par cons\u00e9quent, <b>l&#8217;employeur ne peut pas invoquer le fait qu&rsquo;il a \u00e9t\u00e9 tromp\u00e9 par le salari\u00e9 sur ses capacit\u00e9s physiques \u00e0 occuper le poste.<\/b><span style=\"font-weight: bold;\"><br \/><\/span><\/p>\n<p>D&rsquo;autant plus, si l&#8217;employeur a laiss\u00e9 d\u00e9buter le salari\u00e9 avant sa visite m\u00e9dicale d&#8217;embauche.<\/p>\n<h3>Ce qu&rsquo;il faut retenir<\/h3>\n<p>Le licenciement bas\u00e9 sur l&rsquo;\u00e9tat de sant\u00e9 :<\/p>\n<li> <b>Le licenciement bas\u00e9 sur l&rsquo;\u00e9tat de sant\u00e9 d&rsquo;un salari\u00e9 est illicite et donc consid\u00e9r\u00e9 comme nul.<\/b><\/li>\n<li> <b>Si le salari\u00e9 ne demande pas sa r\u00e9int\u00e9gration il a le droit \u00e0 une indemnit\u00e9 au moins \u00e9gale \u00e0 6 mois de salaire.<\/b><\/li>\n<p>Le fait de mentir par omission sur son \u00e9tat de sant\u00e9 lors de l&rsquo;entretien d&#8217;embauche :<\/p>\n<li> <b>Le salari\u00e9 n&rsquo;a pas \u00e0 confier ses probl\u00e8mes de sant\u00e9 \u00e0 l&#8217;employeur.<\/b><\/li>\n<li> <b>Seule la m\u00e9decine du travail peut \u00eatre inform\u00e9e des \u00e9ventuels probl\u00e8mes de sant\u00e9 du salari\u00e9.<\/b><\/li>\n<p>Arr\u00eat de la Chambre Sociale de la cour de cassation du 21 septembre 2005<\/p>\n<p>Source : <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Les faits Mme X avait \u00e9t\u00e9 engag\u00e9e par une association afin d&rsquo;exercer les fonctions de garde \u00e0 domicile.
