UE, dir. 2008\/115\/CE, 16 d\u00e9c. 2008 : JCP G 2009, act. 4) et \u00ab carte bleue \u00bb,<span style=\"font-weight: bold;\">\u00a0<\/span>dans l&rsquo;objectif de <span style=\"font-weight: bold;\">renforcer la lutte contre l&rsquo;immigration ill\u00e9gale tout en favorisant les canaux d&rsquo;immigration l\u00e9gale.<\/span><\/p>\n<p>Le texte propos\u00e9 par la Commission europ\u00e9enne pr\u00e9voit de <span style=\"font-weight: bold;\">r\u00e9primer l&#8217;employeur d&rsquo;immigrants ill\u00e9gaux et non le migrant<\/span>, en instaurant des peines minimales au niveau europ\u00e9en contre les employeurs, parmi lesquelles :   <\/p>\n<li>des amendes,<\/li>\n<li>le paiement des arri\u00e9r\u00e9s de salaire aux conditions l\u00e9gales<\/li>\n<li>une in\u00e9ligibilit\u00e9 pouvant aller jusqu&rsquo;\u00e0 cinq ans pour les appels d&rsquo;offres publiques et les aides nationales et europ\u00e9ennes.<\/li>\n<p>Le texte pr\u00e9voit \u00e9galement <span style=\"font-weight: bold;\">des sanctions p\u00e9nales contre les employeurs en cas de r\u00e9cidive, <\/span>si un grand nombre de personnes en situation irr\u00e9guli\u00e8re sont employ\u00e9es, si les conditions de travail sont marqu\u00e9es par l&rsquo;exploitation, si la personne employ\u00e9e est victime du trafic d&rsquo;\u00eatres humains au su de son employeur ou encore si elle est mineure.<\/p>\n<p>Un employeur en infraction devra en outre <span style=\"font-weight: bold;\">rembourser les aides per\u00e7ues l&rsquo;ann\u00e9e pr\u00e9c\u00e9dente, et verser une amende graduellement major\u00e9e en fonction du nombre d&rsquo;immigrants ill\u00e9gaux employ\u00e9s.<\/span> <\/p>\n<p>Par ailleurs, il devra <span style=\"font-weight: bold;\">payer une somme \u00e9gale au montant des imp\u00f4ts et cotisations qu&rsquo;il aurait pay\u00e9es si le ressortissant du pays tiers avait \u00e9t\u00e9 employ\u00e9 l\u00e9galement,<\/span> et s&rsquo;il y a lieu, le montant des frais li\u00e9s au retour du migrant.<\/p>\n<p>Les d\u00e9put\u00e9s ont exig\u00e9 que les proc\u00e9dures n\u00e9cessaires pour le recouvrement des r\u00e9mun\u00e9rations impay\u00e9es soient automatiques.<\/p>\n<p>Par ailleurs, le Parlement requiert <span style=\"font-weight: bold;\">la mise en place de m\u00e9canismes permettant aux immigrants ill\u00e9gaux de porter plainte.<\/span> Ainsi, des tiers d\u00e9sign\u00e9s par les \u00c9tats membres, des associations ou des syndicats devraient pouvoir d\u00e9noncer l&#8217;employeur sans risquer d&rsquo;\u00eatre poursuivis pour aide au s\u00e9jour irr\u00e9gulier. <\/p>\n<p>Les immigrants en situation irr\u00e9guli\u00e8re pourront, s&rsquo;ils coop\u00e8rent aux poursuites engag\u00e9es \u00e0 l&rsquo;encontre de leur employeur, <span style=\"font-weight: bold;\">se voir accorder un permis de s\u00e9jour temporaire.<\/span><br style=\"font-weight: bold;\" \/><br \/>Si l&#8217;employeur fautif est un sous-traitant, son contractant direct devra \u00e9galement \u00eatre tenu pour responsable.<\/p>\n<p>Les \u00c9tats membres sont invit\u00e9s \u00e0 <span style=\"font-weight: bold;\">mener \u00ab des inspections efficaces et en nombre suffisant \u00bb<\/span> pour contr\u00f4ler l&#8217;emploi de ressortissants de pays tiers en s\u00e9jour irr\u00e9gulier. <\/p>\n<p>En outre, ils devront exiger des employeurs de v\u00e9rifier que leurs salari\u00e9s ressortissants des pays tiers pr\u00e9sentent un titre de s\u00e9jour valide et informer une autorit\u00e9 nationale des nouveaux recrutements de ressortissants de pays tiers.<\/p>\n<p>La directive sera examin\u00e9e en s\u00e9ance pl\u00e9ni\u00e8re \u00e0 Bruxelles le 19 f\u00e9vrier.<br \/>\u00a0<br \/><span style=\"font-style: italic;\">Source : Communiqu\u00e9 du Parlement Europ\u00e9en, 21 janvier 2009<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Un projet de directive visant \u00e0 sanctionner les employeurs d&rsquo;immigr\u00e9s ill\u00e9gaux et \u00e0 leur assurer des conditions salariales l\u00e9gales a \u00e9t\u00e9 examin\u00e9 par le Parlement europ\u00e9en.
