Cette nouvelle modalit\u00e9, pour le calcul de la prime, d\u00e9savantage la salari\u00e9e qui voit sa prime minor\u00e9e.<\/p>\n<p>Celle-ci saisit le Conseil de prud&rsquo;hommes afin de <b>r\u00e9clamer le paiement de la prime qu&rsquo;elle percevait initialement.<\/b><\/p>\n<h3>Ce que disent les juges<\/h3>\n<p>Les juges constatent que<b> le nouveau crit\u00e8re de calcul de la prime, li\u00e9 au temps de pr\u00e9sence, n&rsquo;\u00e9tait pas pr\u00e9vu par le contrat de travail de la salari\u00e9e.<br \/><\/b><br \/> Les juges consid\u00e8rent que <b>l&#8217;employeur ne peut pas appliquer ce nouveau crit\u00e8re \u00e0 la salari\u00e9e. <\/b>Celui-ci doit respecter les conditions d&rsquo;attribution pr\u00e9vues dans le contrat de travail.<\/p>\n<h3>Ce qu&rsquo;il faut retenir<\/h3>\n<li><b>Le paiement d&rsquo;une prime peut \u00eatre pr\u00e9vu par un accord collectif, uncontrat de travail, un usage ou un engagement unilat\u00e9ral del&#8217;employeur.
