Mais comment s&rsquo;appr\u00e9cie cette majorit\u00e9&nbsp;?<\/p>\n<p>Un accord d&rsquo;entreprise pr\u00e9voyait que l&#8217;employeur, en collaboration avec les organisations syndicales, d\u00e9finirait un contrat de pr\u00e9voyance \u00ab frais de sant\u00e9 \u00bb visant \u00e0 indemniser des frais m\u00e9dicaux rest\u00e9s \u00e0 la charge de l&rsquo;assur\u00e9 et le soumettrait \u00e0 un r\u00e9f\u00e9rendum aupr\u00e8s du personnel.<br \/>Apr\u00e8s qu&rsquo;un premier contrat de pr\u00e9voyance \u00e0 adh\u00e9sion facultative ait \u00e9t\u00e9 d\u00e9nonc\u00e9, l&#8217;employeur a donc organis\u00e9 un r\u00e9f\u00e9rendum pour soumettre un nouveau r\u00e9gime d&rsquo;assurance, cette fois \u00e0 adh\u00e9sion obligatoire, et sur lequel l&rsquo;accord des syndicats n&rsquo;avait pas \u00e9t\u00e9 obtenu. Les propositions ayant \u00e9t\u00e9 approuv\u00e9es \u00e0 la majorit\u00e9 des suffrages exprim\u00e9s, l&#8217;employeur a souscrit le contrat propos\u00e9 pour une prise d&rsquo;effet au 1er janvier suivant.<\/p>\n<p>La cour de cassation rappelle que lorsqu&rsquo;elles ne sont pas d\u00e9termin\u00e9es par voie de conventions ou d&rsquo;accords collectifs, des garanties collectives en compl\u00e9ment de celles de la s\u00e9curit\u00e9 sociale ne peuvent \u00eatre instaur\u00e9es de mani\u00e8re obligatoire pour les salari\u00e9s qu&rsquo;\u00e0 condition que les propositions de l&#8217;employeur aient \u00e9t\u00e9 ratifi\u00e9es par r\u00e9f\u00e9rendum \u00e0 la majorit\u00e9 des int\u00e9ress\u00e9s, ce qui s&rsquo;entend de la majorit\u00e9 des \u00e9lecteurs inscrits (c. s\u00e9c. soc. art. L. 911-1). <\/p>\n<p>Or dans cette affaire, la majorit\u00e9 des suffrages exprim\u00e9s ne repr\u00e9sentait pas la majorit\u00e9 des salari\u00e9s inscrits sur la liste \u00e9lectorale lors du r\u00e9f\u00e9rendum.
