C\u2019est ce que vient de pr\u00e9ciser la Cour de cassation en forme de principe.<\/p>\n\n\n\n<h2 style=\"color: #d10016\"><strong>Les r\u00e8gles de r\u00e9f\u00e9rence <\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La p\u00e9riode de prise des cong\u00e9s pay\u00e9s et l\u2019ordre des d\u00e9parts sont fix\u00e9s par un accord d\u2019entreprise ou d\u2019\u00e9tablissement ou, \u00e0 d\u00e9faut, par une convention ou un accord de branche.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033020765\" target=\"_blank\" rel=\"noreferrer noopener\">Article L. 3141-15 du Code du travail<\/a><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En l\u2019absence de disposition conventionnelle, l\u2019employeur les d\u00e9termine apr\u00e8s avis du CE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035652687\" target=\"_blank\" rel=\"noreferrer noopener\">Article L. 3141-16 du Code du travail<\/a><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Une fois les cong\u00e9s pay\u00e9s fix\u00e9s, les employeurs peu-vent avoir besoin de les modifier (n\u00e9cessit\u00e9s de fonctionnement de l\u2019entreprise, absence d\u2019un salari\u00e9, etc.).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il faut alors respecter un d\u00e9lai de pr\u00e9venance qui peut \u00eatre fix\u00e9 par accord collectif (accord d&rsquo;entreprise ou d&rsquo;\u00e9tablissement ou, \u00e0 d\u00e9faut, convention ou accord de branche).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Article L. 3141-15 du Code du travail<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En l\u2019absence de disposition conventionnelle sur le sujet, l\u2019employeur ne peut pas, sauf en cas de circonstances exceptionnelles, modifier l&rsquo;ordre et les dates de d\u00e9part moins d&rsquo;un mois avant la date de d\u00e9part pr\u00e9vue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Article L. 3141-16 du Code du travail<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans une affaire jug\u00e9e le 2 mars 2022, la Cour de cassation a \u00e9t\u00e9 confront\u00e9e \u00e0 la question de l\u2019application ou non de cette r\u00e8gle du d\u00e9lai de pr\u00e9venance \u00e0 la 5e semaine de cong\u00e9s pay\u00e9s, ainsi qu\u2019\u00e0 des cong\u00e9s conventionnels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans cette affaire, un pr\u00e9avis de gr\u00e8ve illimit\u00e9 avait \u00e9t\u00e9 d\u00e9pos\u00e9 par plusieurs organisations syndicales d\u2019une soci\u00e9t\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Invoquant la paralysie du site en raison de la gr\u00e8ve, l\u2019employeur avait impos\u00e9 aux salari\u00e9s non-gr\u00e9vistes de prendre des cong\u00e9s pay\u00e9s, dont la 5e semaine ainsi que des cong\u00e9s conventionnels, sans respecter le d\u00e9lai l\u00e9gal de pr\u00e9venance de 1 mois.<\/p>\n\n\n\n<h2 style=\"color: #d10016\"><strong>Les arguments de l\u2019employeur pour tenter de se justifier<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019employeur soutenait que les dispositions du Code du travail sur le d\u00e9lai de pr\u00e9venance ne s\u2019appliquaient ni \u00e0 la 5e semaine, ni aux cong\u00e9s conventionnels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour la 5e semaine, il soutenait que celle-ci a un r\u00e9gime juridique particulier, distinct du celui des quatre premi\u00e8res semaines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Concernant les cong\u00e9s pay\u00e9s d&rsquo;origine conventionnelle, ils ne relevaient pas, selon l\u2019employeur, du d\u00e9-lai de pr\u00e9venance du Code du travail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mais, la Cour de cassation tranche et rejette les arguments de l\u2019employeur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Selon elle, en l\u2019absence de stipulation conventionnelle conclue en application de l&rsquo;article L. 3141-15 du Code du travail, l&#8217;employeur ne peut, sauf en cas de circonstances exceptionnelles, modifier l&rsquo;ordre et les dates de d\u00e9part moins d&rsquo;un mois avant la date de d\u00e9part pr\u00e9vue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Article L. 3141-16 du Code du travail<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Par cons\u00e9quent, selon la Cour, aucune distinction ne doit \u00eatre faite entre les quatre premi\u00e8res semaines et la 5e semaine de cong\u00e9s pay\u00e9s.
