Le 9 d\u00e9cembre 2013, les ministres du travail europ\u00e9ens ont renforc\u00e9 la directive relative au d\u00e9tachement en Europe n\u00b0 96\/71\/CE du 16 d\u00e9cembre 1996, ce qui a fait l\u2019objet de vives critiques\u00a0: cette directive favoriserait l\u2019emploi low cost. Les d\u00e9put\u00e9s socialistes ont donc d\u00e9pos\u00e9 une proposition de loi pour limiter le dumping social. Voici les principaux points \u00e0 conna\u00eetre de cette proposition\u00a0:<\/i><\/span><\/p>\n<p>&#8211; Les entreprises qui font appel \u00e0 un <strong>prestataire de services \u00e9tranger<\/strong> pour une mission d\u2019un montant sup\u00e9rieur \u00e0 3000\u20ac doivent v\u00e9rifier que ce dernier est bien d\u00e9clar\u00e9 \u00e0 l\u2019inspection du travail.<\/p>\n<p>&#8211; Le ma\u00eetre d\u2019ouvrage doit \u00eatre solidaire du versement des salaires s\u2019il n\u2019y a pas de paiement de la part du sous-traitant pour un montant \u00e9gal au salaire minimum ou conventionnel \u00e0 partir du moment o\u00f9 le ma\u00eetre d\u2019ouvrage est alert\u00e9 qu\u2019il y a un probl\u00e8me en mati\u00e8re de travail ill\u00e9gal.<\/p>\n<p>&#8211; Le ma\u00eetre d\u2019ouvrage doit fait cesser les situations de travail dissimul\u00e9 au risque de s\u2019exposer \u00e0 une amende et \u00e0 des poursuites judiciaires.<\/p>\n<p>&#8211; Les syndicats doivent pouvoir exercer les droits reconnus \u00e0 la partie civile s\u2019il y a une infraction (travail ill\u00e9gal).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le dumping social est un ph\u00e9nom\u00e8ne de plus en plus courant qui concerne la concurrence entre les travailleurs dans le contexte bien particulier qu\u2019est la mondialisation.
