Jean Paul Bailly, l\u2019ex-pr\u00e9sident de la Poste, a remis le 2 d\u00e9cembre dernier un rapport au Premier ministre visant \u00e0 clarifier les r\u00e8gles du travail le dimanche. Dans cet article, nous allons reprendre les points les plus importants du rapport\u00a0:<\/i><\/span><\/p>\n<h2><b>L\u2019objectif du rapport Bailly<\/b><\/h2>\n<p>Le <strong>rapport Bailly<\/strong> vise \u00e0 red\u00e9finir les contours et les modalit\u00e9s de fonctionnement des zones commerciales et touristiques pour \u00e9viter les in\u00e9galit\u00e9s. Deux types de p\u00e9rim\u00e8tres sont abord\u00e9s\u00a0: les PACT (p\u00e9rim\u00e8tres d\u2019animation concert\u00e9s touristiques) et les PACC (p\u00e9rim\u00e8tres d\u2019animation concert\u00e9s commerciaux).<\/p>\n<h2><b>Les points essentiels du rapport Bailly sur le travail le dimanche<\/b><\/h2>\n<p>Voici les recommandations du rapport Bailly\u00a0:<\/p>\n<p>&#8211; La demande de cr\u00e9ation des zones devra se faire sous la direction du pr\u00e9fet pour les PACC et du pr\u00e9sident de la structure intercommunale pour les PACT. La proc\u00e9dure sera ainsi encadr\u00e9e, ce qui permettra la cr\u00e9ation d\u2019un p\u00e9rim\u00e8tre en six \u00e0 10 mois.<\/p>\n<p>&#8211; <strong>Le travail le dimanche ne doit pas \u00eatre une obligation<\/strong> : il doit se faire sur la base du volontariat.<\/p>\n<p>&#8211; Dans l\u2019accord collectif, des dispositions doivent \u00eatre prises concernant la r\u00e9mun\u00e9ration, l\u2019octroi du repos compensateur et la conciliation entre la vie priv\u00e9e et la vie professionnelle.<\/p>\n<p>&#8211; Le syst\u00e8me des 5 dimanches travaill\u00e9s par an qu\u2019un maire peut accorder aux commerces de d\u00e9tail va \u00eatre modifi\u00e9.
