Par exemple, cette protection concerne les d\u00e9l\u00e9gu\u00e9s du personnel, les repr\u00e9sentants syndicaux ou encore les salari\u00e9s mandat\u00e9s pour n\u00e9gocier un accord collectif. Il existe d\u2019autres situations sp\u00e9cifiques\u00a0: les femmes enceintes et les maladies professionnelles.<\/p>\n<p>&nbsp;<\/p>\n<h2><b>Le verdict de la Cour de Cassation<\/b><\/h2>\n<p>Lorsqu\u2019un <strong>salari\u00e9 prot\u00e9g\u00e9<\/strong> fait l\u2019objet d\u2019un<strong> licenciement pour inaptitude suite \u00e0 une situation de harc\u00e8lement<\/strong>, la situation est diff\u00e9rente. En effet, la rupture ayant \u00e9t\u00e9 autoris\u00e9e par l\u2019inspecteur du travail, il n\u2019est pas possible de saisir le juge judiciaire d\u2019une demande en annulation au titre du principe de s\u00e9paration des 2 ordres juridictionnels, principe d\u00e9j\u00e0 affirm\u00e9 dans un verdict de 2011. Par contre, le salari\u00e9 peut demander une indemnisation du pr\u00e9judice subi du fait du harc\u00e8lement : un arr\u00eat de 27 novembre de la Cour de Cassation a attribu\u00e9 35\u00a0000 \u20ac de dommages et int\u00e9r\u00eats. Dans une autre affaire datant du 20 novembre, le Conseil d\u2019Etat va m\u00eame plus loin en contestant la possibilit\u00e9 d\u2019\u00eatre saisi d\u2019une demande tendant \u00e0 remettre en cause l\u2019autorisation de licenciement.
