Si les dispositions l\u00e9gales relatives \u00e0 la rupture conventionnelle n\u2019ont pas repris ce principe, la circulaire du 17 mars 2009 a rappel\u00e9 le caract\u00e8re d\u2019ordre public de ces dispositions et les cours d\u2019appel d\u2019Orl\u00e9ans et de Rouen consid\u00e8rent les conventions sign\u00e9es dans un tel contexte comme nulles, la rupture produisant alors les effets d\u2019un licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p>&nbsp;<\/p>\n<h2><b>La rupture conventionnelle et la maternit\u00e9<\/b><\/h2>\n<p>Pendant son cong\u00e9 maternit\u00e9, la femme est prot\u00e9g\u00e9e.
