des heures de d\u00e9l\u00e9gation pendant un arr\u00eat maladie (Cass. chambre mixte, 21 mars 2014, 12-20002)<\/h2>\n<p>Du point de vue du droit du travail, <strong>un arr\u00eat maladie n&#8217;emporte pas suspension du mandat,<\/strong> supposant donc que le <a href=\"http:\/\/www.gereso.com\/formations\/droit-du-travail\/formation-representants-du-personnel\">repr\u00e9sentant du personnel<\/a> soit toujours convoqu\u00e9 aux r\u00e9unions et autorisant l&rsquo;int\u00e9ress\u00e9 \u00e0 circuler dans l&rsquo;entreprise et \u00e0 utiliser son cr\u00e9dit d&rsquo;heures de d\u00e9l\u00e9gation.<\/p>\n<p>N\u00e9anmoins, le code la s\u00e9curit\u00e9 sociale interdit au salari\u00e9 en arr\u00eat maladie d&rsquo;exercer une activit\u00e9 non autoris\u00e9e par le m\u00e9decin prescripteur et autorise la caisse \u00e0 retenir tout ou partie des indemnit\u00e9s journali\u00e8res en cas de violation de cette obligation.<\/p>\n<figure id=\"attachment_3058\" aria-describedby=\"caption-attachment-3058\" style=\"width: 500px\" class=\"wp-caption aligncenter\"><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-3058\" class=\"wp-caption-text\">Pour b\u00e9n\u00e9ficier du paiement de leurs heures de d\u00e9l\u00e9gation, les d\u00e9l\u00e9gu\u00e9s du personnel souhaitant exercer leur mandat pendant leur arr\u00eat maladie doit recueillir l&rsquo;autorisation de leur m\u00e9decin traitant<\/figcaption><\/figure>\n<p>C&rsquo;est dans ce contexte que la Cour de cassation, r\u00e9unie en chambre mixte (deuxi\u00e8me chambre civile, chambre sociale et chambre criminelle) a \u00e9t\u00e9 amen\u00e9e \u00e0 se prononcer et \u00e0 tenter de cordonner les diff\u00e9rentes logiques.<\/p>\n<p>Il a ainsi \u00e9t\u00e9 d\u00e9cid\u00e9 que l<strong>&lsquo;exercice du mandat durant un arr\u00eat maladie n&rsquo;ouvre droit au paiement \u00a0des heures de d\u00e9l\u00e9gation que si cette activit\u00e9 a \u00e9t\u00e9 autoris\u00e9e par le m\u00e9decin traitant lors de la d\u00e9livrance de l&rsquo;arr\u00eat de travail<\/strong> puisqu&rsquo;\u00e0 d\u00e9faut, le b\u00e9n\u00e9fice des indemnit\u00e9s journali\u00e8res peut \u00eatre remis en cause et l&#8217;employeur peut d\u00e9cider de ne pas verser la r\u00e9mun\u00e9ration pour les heures de d\u00e9l\u00e9gation correspondantes.<\/p>\n<p>Cela devrait donc inciter les <a href=\"http:\/\/www.gereso.com\/formations\/droit-du-travail\/formation-representants-du-personnel\">repr\u00e9sentants \u00e9lus ou d\u00e9sign\u00e9s<\/a> soit, s&rsquo;ils souhaitent poursuivre leur activit\u00e9 durant un arr\u00eat de travail, \u00e0 <strong>solliciter leur m\u00e9decin traitant sur ce point, s<\/strong>eul \u00e0 m\u00eame de juger de la compatibilit\u00e9 de cette activit\u00e9 avec leur \u00e9tat de sant\u00e9, soit \u00e0 faire jouer les r\u00e8gles de la
