travail<\/strong><\/em><\/span><\/a><\/p>\n<p>En l\u2019esp\u00e8ce, l\u2019affectation d\u2019un chef de chantier, employ\u00e9 par une entreprise de travaux publics, sur des chantiers situ\u00e9s sur l\u2019ensemble du territoire national constitue <strong>un changement des conditions de travail et non du contrat,<\/strong> relevant du pouvoir de direction de l\u2019employeur, peu importe si ses pr\u00e9c\u00e9dentes missions \u00e9taient localis\u00e9es sur l\u2019est de la France.<\/p>\n<p>Le refus est donc fautif mais la Cour de cassation estime que <strong>ce refus de mobilit\u00e9 ne constitue pas une faute grave<\/strong>, \u00e9tant donn\u00e9, notamment, l\u2019absence de pr\u00e9cision, de la part de l\u2019employeur, sur la dur\u00e9e pr\u00e9visible de ce d\u00e9placement.<\/p>\n<p>Cette position n\u2019est pas nouvelle puisque\u00a0:<\/p>\n<ul>\n<li>en 2000, il avait d\u00e9j\u00e0 \u00e9t\u00e9 jug\u00e9 qu\u2019une consultante cadre, recrut\u00e9e pour sa maitrise de la langue allemande et dont le contrat pr\u00e9voit des d\u00e9placements en province ne peut refuser un d\u00e9placement en Allemagne\u00a0;<\/li>\n<li>en 2003, elle avait d\u00e9j\u00e0 estim\u00e9 qu\u2019un cadre, chef de chantier, ne pouvait refuser une affectation de deux mois sur un chantier, \u00e9loign\u00e9 de la r\u00e9gion o\u00f9 il travaillait, habituellement, depuis une dizaine d\u2019ann\u00e9es, d\u00e8s lors que la sp\u00e9cificit\u00e9 de ses fonctions impliquait une certaine mobilit\u00e9 g\u00e9ographique.<\/li>\n<\/ul>\n<p>Dans cette affaire,<strong> le salari\u00e9 ne pouvait soutenir qu\u2019il s\u2019agissait d\u2019un d\u00e9placement occasionnel<\/strong> en dehors de son secteur d\u2019intervention habituel, subordonn\u00e9 au respect de trois conditions\u00a0:<\/p>\n<ul>\n<li>qu\u2019il soit justifi\u00e9 par l\u2019int\u00e9r\u00eat de l\u2019entreprise<\/li>\n<li>qu\u2019il soit motiv\u00e9 par des circonstances exceptionnelles<\/li>\n<li>qu\u2019il s\u2019accompagne d\u2019une information pr\u00e9alable du salari\u00e9 en respectant un d\u00e9lai raisonnable, compte tenu des implications de cette mobilit\u00e9, et en indiquant sa dur\u00e9e pr\u00e9visible.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation a
