{"id":3198,"date":"2014-05-21T15:08:35","date_gmt":"2014-05-21T13:08:35","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=3198"},"modified":"2014-05-21T15:08:35","modified_gmt":"2014-05-21T13:08:35","slug":"remise-en-cause-du-statut-relatif-au-portage-salarial","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2014\/05\/21\/remise-en-cause-du-statut-relatif-au-portage-salarial\/","title":{"rendered":"Remise en cause du statut relatif au portage salarial"},"content":{"rendered":"<p><strong>(<\/strong><strong>Cons. const., 11\u00a0avril 2014, n\u00b0\u00a02014-388 QPC)<\/strong><\/p>\n<p>L\u2019article 8 III de la loi de modernisation du march\u00e9 du travail du 25\u00a0juin 2008 a renvoy\u00e9 l\u2019organisation du portage salarial \u00e0 une <strong>n\u00e9gociation de branche<\/strong>, en la confiant \u00e0 celle du <strong>travail temporaire<\/strong> consid\u00e9r\u00e9e comme la plus apte \u00e0 en cerner les enjeux et \u00e0 d\u00e9finir un cadre.<\/p>\n<p>Le l\u00e9gislateur s\u2019est, en effet, limit\u00e9 \u00e0 poser, dans l\u2019article L. 1251-64 du Code du travail, une <strong>d\u00e9finition g\u00e9n\u00e9rale<\/strong> selon laquelle \u00ab\u00a0<em>le portage salarial est un ensemble de relations contractuelles organis\u00e9es entre une entreprise de portage, une personne port\u00e9e et des entreprises clientes comportant pour la personne port\u00e9e le r\u00e9gime du salariat et la r\u00e9mun\u00e9ration de sa prestation chez le client par l\u2019entreprise de portage. Il garantit les droits de la personne port\u00e9e sur son apport de client\u00e8le\u00a0<\/em>\u00bb.<\/p>\n<p>La n\u00e9gociation a abouti \u00e0 l\u2019accord national interprofessionnel du 24 juin 2010, \u00e9tendu par un arr\u00eat\u00e9 du 24 mai 2013 qui a fait l\u2019objet d\u2019un <strong>recours en annulation et d\u2019une question prioritaire de constitutionnalit\u00e9<\/strong> par la CGT-FO et la F\u00e9d\u00e9ration des employ\u00e9s et cadres FO.<\/p>\n<p>Dans ce contexte, le Conseil constitutionnel a estim\u00e9 que <strong>le l\u00e9gislateur a m\u00e9connu l\u2019\u00e9tendue de sa comp\u00e9tence<\/strong> en renvoyant aux partenaires sociaux, dans le cadre de l\u2019article 8 III de la loi de modernisation du march\u00e9 du travail, le soin de fixer le r\u00e9gime juridique du portage salarial.<\/p>\n<p>Il appartenait, en effet, au l\u00e9gislateur de d\u00e9terminer les conditions essentielles de l\u2019exercice de l\u2019activit\u00e9 \u00e9conomique de portage salarial et de fixer les principes applicables au salari\u00e9 port\u00e9.<\/p>\n<p><strong>Or,<\/strong> <strong>les partenaires sociaux ont fait le choix d\u2019un champ d\u2019application restreint<\/strong> en limitant le portage salarial aux cadres ce qui affecte la libert\u00e9 d\u2019entreprendre et les droits collectifs des salari\u00e9s.<\/p>\n<p>Le Conseil constitutionnel a donc d\u00e9cid\u00e9 de censurer l\u2019article 8 III de la loi de modernisation du march\u00e9 du travail en reportant les effets au 1 janvier 2015 afin de permettre au l\u00e9gislateur de tirer les cons\u00e9quences de cette d\u00e9cision.<\/p>\n<p>Celui-ci est donc <strong>appel\u00e9 \u00e0 intervenir dans les 8 prochains mois pour fixer les bases minimales du portage salarial.<\/strong> Dans cette attente, l\u2019accord national interprofessionnel du 24\u00a0juin 2010 \u00e9tendu par l\u2019arr\u00eat\u00e9 du 24\u00a0mai 2013, demeure applicable mais il pourra \u00eatre contest\u00e9 d\u00e8s le 1<sup>er<\/sup> \u00a0janvier 2015 s\u2019il n\u2019a pas \u00e9t\u00e9 abrog\u00e9 ou remplac\u00e9 dans l\u2019intervalle.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>(Cons. const., 11\u00a0avril 2014, n\u00b0\u00a02014-388 QPC) L\u2019article 8 III de la loi de modernisation du march\u00e9 du travail du 25\u00a0juin 2008 a renvoy\u00e9 l\u2019organisation du portage salarial \u00e0 une n\u00e9gociation de branche, en la confiant \u00e0 celle du travail temporaire consid\u00e9r\u00e9e comme la plus apte \u00e0 en cerner les enjeux et \u00e0 d\u00e9finir un cadre.
