{"id":3441,"date":"2014-07-15T13:55:35","date_gmt":"2014-07-15T11:55:35","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=3441"},"modified":"2014-07-15T13:55:35","modified_gmt":"2014-07-15T11:55:35","slug":"les-consequences-du-non-respect-de-la-procedure-disciplinaire-sur-la-validite-de-la-rupture-anticipee-dun-cdd","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2014\/07\/15\/les-consequences-du-non-respect-de-la-procedure-disciplinaire-sur-la-validite-de-la-rupture-anticipee-dun-cdd\/","title":{"rendered":"Les cons\u00e9quences du non-respect de la proc\u00e9dure disciplinaire sur la validit\u00e9 de la rupture anticip\u00e9e d\u2019un CDD"},"content":{"rendered":"<p><strong>(Cass. soc., 14 mai 2014, 13-12071)<\/strong><\/p>\n<p>Lorsqu\u2019elle repose sur une faute pouvant \u00eatre qualifi\u00e9e de grave, l\u2019employeur est tenu de respecter la <strong>proc\u00e9dure disciplinaire pour rompre un CDD.<\/strong><\/p>\n<p>Il doit donc convoquer le salari\u00e9 \u00e0 un entretien pr\u00e9alable en lui pr\u00e9cisant que la rupture de son contrat est envisag\u00e9e et lui laisser un d\u00e9lai raisonnable, <strong>d\u2019au minimum 3 jours ouvrables<\/strong> pour lui permettre d\u2019organiser sa d\u00e9fense.<\/p>\n<p>Apr\u00e8s l\u2019entretien, il doit respecter un d\u00e9lai de <strong>2 jours ouvrables<\/strong> avant de notifier la rupture par une lettre motiv\u00e9e. Si cette derni\u00e8re formalit\u00e9 n\u2019est pas respect\u00e9e, la rupture est consid\u00e9r\u00e9e comme abusive ouvrant droit \u00e0 une indemnit\u00e9 au moins \u00e9gale aux salaires qui auraient \u00e9t\u00e9 dus jusqu\u2019au terme initialement pr\u00e9vu.<\/p>\n<p>En revanche, le d\u00e9faut d\u2019entretien, consid\u00e9r\u00e9 comme une garantie de proc\u00e9dure et non de fond, n\u2019a pas les m\u00eames cons\u00e9quences. S\u2019il ouvre droit \u00e0 r\u00e9paration, le montant des dommages-int\u00e9r\u00eats est laiss\u00e9 \u00e0 l\u2019appr\u00e9ciation des juges du fond.
