Il pr\u00e9voit notamment une baisse minime des cotisations et une r\u00e9vision du bonus\/malus dans un sens favorable aux entreprises. Ces mesures devront \u00eatre valid\u00e9es par le gouvernement pour devenir applicable.<\/p>\n\n\n\n<h2 style=\"color:#D10016\"><strong>Contexte <\/strong><\/h2>\n\n\n\n<p>La derni\u00e8re s\u00e9ance de n\u00e9gociation du 10 novembre a d\u00e9bouch\u00e9 sur un projet de <strong>protocole d&rsquo;accord pour la p\u00e9riode 2024-2027,<\/strong> d\u00e9sormais soumis \u00e0 la signature des organisations.<\/p>\n\n\n\n<p>Les modalit\u00e9s d\u00e9taill\u00e9es de l&rsquo;accord sign\u00e9 par les organisations seront ensuite pr\u00e9cis\u00e9es dans la convention d&rsquo;assurance ch\u00f4mage et les textes n\u00e9cessaires \u00e0 son application (r\u00e8glement, etc.). La convention sera ensuite soumise \u00e0 l&rsquo;agr\u00e9ment du Premier ministre. Si elle est agr\u00e9\u00e9e, elle pourra rentrer en vigueur. <\/p>\n\n\n\n<p>C\u00f4t\u00e9 des cotisations patronales, le protocole pr\u00e9voit deux mesures. <\/p>\n\n\n\n<h2 style=\"color:#D10016\"><strong>Baisse de la cotisation patronale de droit commun<\/strong><\/h2>\n\n\n\n<p>Le protocole pr\u00e9voit de <strong>baisser de 0,05 point<\/strong> la cotisation patronale de droit commun, qui passerait donc de 4,05\u00a0% \u00e0 4\u00a0%. <\/p>\n\n\n\n<p><em>Article 8<\/em><\/p>\n\n\n\n<h2 style=\"color:#D10016\"><strong>Adaptation du bonus \/ malus sur la contribution patronale<\/strong><\/h2>\n\n\n\n<p>La seconde modification pr\u00e9vue concerne le syst\u00e8me de <strong>bonus\/malus sur la contribution patronale des employeurs de 11 salari\u00e9s et plus de certains secteurs<\/strong> d\u2019activit\u00e9 particuli\u00e8rement concern\u00e9s par le recours aux contrats courts.<\/p>\n\n\n\n<p>Article 9<\/p>\n\n\n\n<p>Ce dispositif, applicable depuis le 1er septembre 2022, consiste \u00e0 moduler le taux des entreprises concern\u00e9es soit \u00e0 la baisse (bonus), soit \u00e0 la hausse (malus), au regard du rapport entre&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le taux de s\u00e9paration de l\u2019entreprise (sch\u00e9matiquement le nombre de fins de contrat de travail ou de missions d\u2019int\u00e9rim imputables \u00e0 l\u2019entreprise ayant donn\u00e9 lieu \u00e0 inscription \u00e0 P\u00f4le Emploi, rapport\u00e9e \u00e0 son effectif \u00ab&nbsp;S\u00e9curit\u00e9 sociale&nbsp;\u00bb) ;<\/li>\n\n\n\n<li>Et le taux de s\u00e9paration m\u00e9dian de son secteur d&rsquo;activit\u00e9, diffus\u00e9 chaque ann\u00e9e par arr\u00eat\u00e9. <\/li>\n<\/ul>\n\n\n\n<p>Entre autres dispositions, le protocole d\u2019accord pr\u00e9voit de <strong>ne plus prendre en compte certaines ruptures de contrat de travail<\/strong> consid\u00e9r\u00e9es comme \u00ab\u00a0ind\u00e9pendantes de la volont\u00e9 des employeurs\u00a0\u00bb\u00a0:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les fins de CDD (ou de contrats de missions d&rsquo;int\u00e9rim) de remplacement&nbsp;;<\/li>\n\n\n\n<li>les fins de contrats saisonniers&nbsp;;<\/li>\n\n\n\n<li>les ruptures conventionnelles&nbsp;;<\/li>\n\n\n\n<li>les licenciements pour inaptitude d&rsquo;origine non professionnelles&nbsp;;<\/li>\n\n\n\n<li>les licenciements pour faute lourde.<\/li>\n<\/ul>\n\n\n\n<p>Par ailleurs, \u00ab&nbsp;afin de recentrer le dispositif sur son objectif premier&nbsp;\u00bb, le protocole pr\u00e9voit que <strong>seules les fins de contrats de travail d\u2019une dur\u00e9e inf\u00e9rieure \u00e0 un mois seraient prises en compte<\/strong>.
