Ce dernier b\u00e9n\u00e9fice d\u2019une <strong>allocation journali\u00e8re de pr\u00e9sence parentale<\/strong> (AJPP) vers\u00e9e par les caisses d\u2019allocations familiales (CAF).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038219306#:~:text=Le%20droit%20est%20ouvert%20pour,ni%20sup%C3%A9rieure%20%C3%A0%20un%20an.\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Code de la S\u00e9curit\u00e9 sociale article L544-2<\/em><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depuis le 17&nbsp;novembre&nbsp;2021, le salari\u00e9 ayant atteint le nombre maximal de 310 jours de cong\u00e9 avant l\u2019expiration de la p\u00e9riode de 3&nbsp;ans peut, \u00e0 <strong>titre exceptionnel et par d\u00e9rogation<\/strong>, b\u00e9n\u00e9ficier d\u2019un <strong>renouvellement<\/strong> de son cong\u00e9 au titre de la m\u00eame maladie, du m\u00eame handicap ou du m\u00eame accident dont l\u2019enfant a \u00e9t\u00e9 victime <strong>avant le terme de la p\u00e9riode de 3&nbsp;ans<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Code du travail article L1225-62, dernier alin\u00e9a<\/em><\/p>\n\n\n\n<article class=\"obj_encart-formation\">\n<div class=\"ctn_encart\">\n<h3>Votre formation sur ce th\u00e8me<\/h3>\n<h2>&nbsp;PRESTATIONS DE LA S\u00c9CURIT\u00c9 SOCIALE&nbsp;<\/h2>\n<h4>2 jours &#8211; En pr\u00e9sentiel ou \u00e0 distance<\/h4>\n<ul>\n<li><strong>Respecter le cadre juridique<\/strong> des prestations du r\u00e9gime g\u00e9n\u00e9ral de la s\u00e9curit\u00e9 sociale.<\/li>\n<li><strong>Analyser le r\u00f4le de l&#8217;employeur<\/strong> dans la gestion des prestations sociales.<\/li>\n<li><strong>Traiter les probl\u00e8mes<\/strong> li\u00e9s aux arr\u00eats maladie, accidents du travail, cong\u00e9s maternit\u00e9, invalidit\u00e9.<\/li>\n<li><strong>D\u00e9terminer le montant<\/strong> des diff\u00e9rentes Indemnit\u00e9s Journali\u00e8res de la S\u00e9curit\u00e9 Sociale (IJSS).<\/li>\n<\/ul>\n<div class=\"ctn_btn\">\n<a class=\"obj_btn\" target=\"_blank\" href=\"https:\/\/www.gereso.com\/SECU\" rel=\"noopener\"><span>En savoir plus<\/span><\/a>\n<a class=\"obj_btn\" target=\"_blank\" href=\"https:\/\/www.gereso.com\/client\/programme-pdf\/SECU.pdf\" rel=\"noopener\"><span>T\u00e9l\u00e9charger le programme PDF<\/span><\/a>\n<\/div>\n<\/article>\n\n\n\n<h2 style=\"color:#D10016\"><strong>Le renouvellement d\u00e9rogatoire du cong\u00e9 encourag\u00e9<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le r\u00e9gime du cong\u00e9 de pr\u00e9sence parentale a \u00e9t\u00e9 modifi\u00e9 sur plusieurs points par la <strong>loi du 19&nbsp;juillet&nbsp;2023<\/strong> visant \u00e0 renforcer les droits des familles d\u2019enfants atteints d\u2019une maladie ou d\u2019un handicap ou victimes d\u2019un accident d\u2019une particuli\u00e8re gravit\u00e9 (<a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047862209\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Loi&nbsp;2023-622 du 19&nbsp;juillet&nbsp;2023, Journal Officiel du 20<\/em><\/a>)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La loi a notamment <strong>assoupli la proc\u00e9dure d\u00e9rogatoire de renouvellement<\/strong> du cong\u00e9, \u00e0 savoir celle qui est mise en \u0153uvre avant le terme de la p\u00e9riode de 3&nbsp;ans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Comme ant\u00e9rieurement, pour b\u00e9n\u00e9ficier de ce renouvellement d\u00e9rogatoire, le salari\u00e9 doit produire un <strong>nouveau certificat m\u00e9dical<\/strong> du m\u00e9decin suivant l\u2019enfant qui atteste du caract\u00e8re indispensable de la poursuite des soins contraignants et d\u2019une pr\u00e9sence soutenue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Code du travail article L1225-62<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depuis le 21&nbsp;juillet&nbsp;2023, il n\u2019est <strong>plus n\u00e9cessaire d\u2019obtenir l\u2019accord explicite<\/strong> du service du contr\u00f4le m\u00e9dical de la CPAM.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000047862213\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Loi&nbsp;2023-622 du 19&nbsp;juillet&nbsp;2023, article&nbsp;4,&nbsp;II<\/em><\/a><em>&nbsp;; Code du travail article&nbsp;L1225-62 modifi\u00e9<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le d\u00e9cret du 2&nbsp;f\u00e9vrier&nbsp;2024 modifie et compl\u00e8te les dispositions r\u00e9glementaires du Code du travail et du Code de la S\u00e9curit\u00e9 sociale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000049085176\" target=\"_blank\" rel=\"noreferrer noopener\"><em>D\u00e9cret&nbsp;2024-78 du 2&nbsp;f\u00e9vrier&nbsp;2024, Journal Officiel du&nbsp;4<\/em><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il est d\u00e9sormais pr\u00e9cis\u00e9 que lorsque le renouvellement de l\u2019AJPP est demand\u00e9 avant le terme de la p\u00e9riode de 3&nbsp;ans, <strong>le salari\u00e9 doit adresser \u00e0 la CAF<\/strong>, sous pli ferm\u00e9 \u00e0 l\u2019attention du service du contr\u00f4le m\u00e9dical, <strong>le nouveau certificat m\u00e9dical<\/strong> d\u00e9taill\u00e9 attestant le caract\u00e8re indispensable, au regard du traitement, de la pathologie ou du besoin d\u2019accompagnement de l\u2019enfant, de la poursuite des soins contraignants et d\u2019une pr\u00e9sence soutenue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000049085191\" target=\"_blank\" rel=\"noreferrer noopener\"><em>D\u00e9cret&nbsp;2024-78 du 2&nbsp;f\u00e9vrier&nbsp;2024, article&nbsp;1<\/em><\/a><em>&nbsp;; <\/em><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000045709278\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Code de la S\u00e9curit\u00e9 sociale article&nbsp;R544-1&nbsp;modifi\u00e9<\/em><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le d\u00e9cret confirme par ailleurs que l\u2019accord du service du contr\u00f4le m\u00e9dical peut \u00eatre implicite. Le silence gard\u00e9 jusqu\u2019au dernier jour du 2<sup>e<\/sup>&nbsp;mois&nbsp;civil suivant la r\u00e9ception de la demande d\u2019AJPP valant accord.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>D\u00e9cret&nbsp;2024-78 du 2&nbsp;f\u00e9vrier&nbsp;2024, article&nbsp;1&nbsp;; <\/em><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049090510\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Code de la S\u00e9curit\u00e9 sociale article&nbsp;R544-3&nbsp;modifi\u00e9<\/em><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le d\u00e9cret acte la suppression de l\u2019obligation pour le salari\u00e9 de joindre l\u2019avis favorable rendu par le service du contr\u00f4le m\u00e9dical, lorsqu\u2019il demande le renouvellement d\u00e9rogatoire du cong\u00e9 \u00e0 son employeur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000049085199\" target=\"_blank\" rel=\"noreferrer noopener\"><em>D\u00e9cret&nbsp;2024-78 du 2&nbsp;f\u00e9vrier&nbsp;2024, article&nbsp;2<\/em><\/a><em>&nbsp;; <\/em><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049090537\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Code du travail article&nbsp;R1225-14&nbsp;modifi\u00e9<\/em><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il suffit donc du nouveau certificat m\u00e9dical du m\u00e9decin traitant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>D\u00e9cret&nbsp;2024-78 du 2&nbsp;f\u00e9vrier&nbsp;2024, Journal Officiel du&nbsp;4<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rappel Le salari\u00e9 dont l\u2019enfant \u00e0 charge est atteint d\u2019une maladie, d\u2019un handicap ou est victime d\u2019un accident d\u2019une particuli\u00e8re gravit\u00e9 rendant indispensables une pr\u00e9sence soutenue et des soins contraignants a droit, sous conditions, \u00e0 un cong\u00e9 de pr\u00e9sence parentale maximal de 310&nbsp;jours ouvr\u00e9s sur 3&nbsp;ans.
