Ce dernier remplace l\u2019ANI (accord national interprofessionnel) de 2008 qui jusque-l\u00e0 r\u00e9glementait la portabilit\u00e9 (sauf accord plus favorable).<\/p>\n<p>Cette portabilit\u00e9 permettait pour le b\u00e9n\u00e9ficiaire de maintenir les garanties de son <strong>contrat de pr\u00e9voyance<\/strong> pour une dur\u00e9e proportionnelle \u00e0 la dur\u00e9e du dernier contrat de travail, dans la limite de 12 mois, et mettait en place un m\u00e9canisme financement obligatoirement mutualis\u00e9 (par l\u2019employeur et les salari\u00e9s actifs).<\/p>\n<p><strong>La loi de s\u00e9curisation avait pr\u00e9vu une introduction de ce m\u00e9canisme en deux temps\u00a0:<\/strong><\/p>\n<ul>\n<li>Au 1<sup>er<\/sup> juin 2014 en ce qui concerne les risques portant atteinte \u00e0 l&rsquo;int\u00e9grit\u00e9 physique de la personne ou li\u00e9s \u00e0 la maternit\u00e9\u00a0;<\/li>\n<li>Au 1<sup>er<\/sup>\u00a0juin 2015 en ce qui concerne les garanties li\u00e9es aux risques d\u00e9c\u00e8s, d&rsquo;incapacit\u00e9 de travail ou d&rsquo;invalidit\u00e9.<\/li>\n<\/ul>\n<p>La Cour de cassation (arr\u00eat du 23\u00a0mai 2012, n\u00b0\u00a011-17549, BC\u00a0V n\u00b0\u00a0158) avait pr\u00e9cis\u00e9 que le point de d\u00e9part pour l\u2019applicabilit\u00e9 de la portabilit\u00e9 \u00e9tait la date de notification de la rupture du contrat de travail. Ainsi, une rupture notifi\u00e9e avant le\u00a0 1<sup>er<\/sup> juin 2015, mais ayant un pr\u00e9avis expirant apr\u00e8s cette date, ne b\u00e9n\u00e9ficierait pas de la portabilit\u00e9 des garanties li\u00e9es aux risques d\u00e9c\u00e8s, d&rsquo;incapacit\u00e9 de travail ou d&rsquo;invalidit\u00e9 (sauf accord plus favorable).<\/p>\n<p style=\"text-align: center;\"><strong><em>Pour rappel, une mention relative au dispositif de portabilit\u00e9 doit \u00eatre indiqu\u00e9e sur le certificat de travail.
