{"id":4215,"date":"2015-06-26T11:12:16","date_gmt":"2015-06-26T09:12:16","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=4215"},"modified":"2015-06-26T11:12:16","modified_gmt":"2015-06-26T09:12:16","slug":"droit-du-travail-cas-particuliers","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2015\/06\/26\/droit-du-travail-cas-particuliers\/","title":{"rendered":"Droit du travail : cas particuliers"},"content":{"rendered":"<h2><strong>En cas d\u2019absence de clause de non-concurrence, un salari\u00e9 peut travailler chez un nouvel employeur durant la dur\u00e9e du pr\u00e9avis non ex\u00e9cut\u00e9<\/strong><\/h2>\n<p>Depuis un arr\u00eat de la Cour de cassation du 22 d\u00e9cembre 1988 (n\u00ba 86-43.506), un salari\u00e9 dispens\u00e9 de l\u2019ex\u00e9cution de son\u00a0pr\u00e9avis\u00a0peut travailler chez un autre employeur\u00a0pendant la p\u00e9riode correspondant au pr\u00e9avis th\u00e9orique. Il cumulera donc l\u2019indemnit\u00e9 compensatrice de pr\u00e9avis et sa nouvelle r\u00e9mun\u00e9ration.<\/p>\n<p>Dans un arr\u00eat du 6 mai 2015 (14-11.001) la Cour de cassation rappelle que m\u00eame si le nouvel employeur est un concurrent, le salari\u00e9 qui n\u2019est\u00a0 pas li\u00e9 par une clause de non-concurrence pourra int\u00e9grer cette entreprise. De plus, si le salari\u00e9 est dispens\u00e9 de pr\u00e9avis, l\u2019obligation de loyaut\u00e9\u00a0qui r\u00e9sulte du contrat de travail\u00a0n\u2019a plus d\u2019effet d\u00e8s la rupture,\u00a0l\u2019employeur ne pourra pas mener une action en concurrence d\u00e9loyale.<\/p>\n<h2><strong>Le refus d\u2019afficher et d\u2019enregistrer les horaires apr\u00e8s plusieurs rappels de l\u2019inspection du travail constitue \u00ab\u00a0un obstacle au contr\u00f4le\u00a0\u00bb<\/strong><\/h2>\n<p>L\u2019inspection du travail avait effectu\u00e9 plusieurs rappels \u00e0 un chef d\u2019une exploitation agricole, qui n\u2019avait qu\u2019un salari\u00e9, pour proc\u00e9der \u00e0 l\u2019enregistrement et l\u2019affichage des horaires de travail (<em>articles L3171-1 et L3171-3 du Code du travail<\/em>). Face au refus de l\u2019employeur de s\u2019ex\u00e9cuter, l\u2019inspecteur avait \u00e9tabli un proc\u00e8s-verbal pour \u00ab\u00a0obstacle au contr\u00f4le\u00a0\u00bb (<em>article L 8114-1 du Code du travail<\/em>)<\/p>\n<p>L\u2019employeur consid\u00e9rait que l\u2019inspection du travail ne pouvait lui reprocher de faire obstacle au contr\u00f4le dans le sens o\u00f9 il n\u2019avait pas emp\u00each\u00e9 l\u2019inspecteur d\u2019accomplir sa mission.<\/p>\n<p>Cependant, la Cour de cassation, dans un arr\u00eat du 14 avril 2015 (N\u00b014-83267) rejette son argument en pr\u00e9cisant qu\u2019en refusant de proc\u00e9der \u00e0 l\u2019enregistrement et \u00e0 l\u2019affichage des horaires de travail, \u00ab\u00a0<em>l\u2019employeur avait, de fait, emp\u00each\u00e9 l\u2019inspecteur du travail de contr\u00f4ler l\u2019application des dispositions relatives \u00e0 la dur\u00e9e et \u00e0 l\u2019am\u00e9nagement du temps de travail<\/em>.\u00a0\u00bb<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>En cas d\u2019absence de clause de non-concurrence, un salari\u00e9 peut travailler chez un nouvel employeur durant la dur\u00e9e du pr\u00e9avis non ex\u00e9cut\u00e9 Depuis un arr\u00eat de la Cour de cassation du 22 d\u00e9cembre 1988 (n\u00ba 86-43.506), un salari\u00e9 dispens\u00e9 de l\u2019ex\u00e9cution de son\u00a0pr\u00e9avis\u00a0peut travailler chez un autre employeur\u00a0pendant la p\u00e9riode correspondant au pr\u00e9avis th\u00e9orique.
