Si ce dernier peut l\u00e9gitimement choisir librement la forme du recrutement, certaines r\u00e8gles existent pour prot\u00e9ger les candidats \u00e0 l\u2019emploi des risques de discriminations.<\/em><\/p>\n<p>&nbsp;<\/p>\n<h2><strong>Les discriminations prohib\u00e9es <\/strong><\/h2>\n<p><strong>Certaines informations ne peuvent ainsi pas \u00eatre l\u00e9galement demand\u00e9es au candidat<\/strong>, en application de l\u2019article L1132-1 du Code du travail prohibant\u00a0les discriminations \u00e0 l\u2019embauche. Les questions doivent en effet<strong> rester en lien direct et n\u00e9cessaire avec l\u2019emploi propos\u00e9<\/strong>, et leur unique but doit \u00eatre d\u2019appr\u00e9cier la capacit\u00e9 du candidat \u00e0 occuper le poste concern\u00e9.<\/p>\n<p>Les questions relatives \u00e0 la vie priv\u00e9e, touchant \u00e0 la situation maritale, \u00e0 l\u2019\u00e9tat de sant\u00e9, de grossesse, ou aux enfants \u00e9ventuels du candidat sont donc interdites.<\/p>\n<p>De m\u00eame,<strong> les questions tenant \u00e0 la religion ou \u00e0 l\u2019origine du candidat sont discriminatoires et prohib\u00e9es.<\/strong><\/p>\n<p>Les <strong>informations relatives au casier judiciaire du candidat<\/strong> ne peuvent en principe pas \u00eatre demand\u00e9es, sauf pour certaines fonctions particuli\u00e8res.<\/p>\n<p>Enfin, il est interdit \u00e0 l\u2019employeur d\u2019interroger le candidat sur son \u00e9ventuelle appartenance syndicale ou politique.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>Les questions autoris\u00e9es <\/strong><\/h2>\n<p>Certaines questions personnelles, en ce qu\u2019elle pr\u00e9sentent un lien avec le poste, sont cependant autoris\u00e9es : ainsi, l\u2019employeur pourra l\u00e9gitimement demander au candidat s\u2019il est titulaire du permis de conduire dans la mesure o\u00f9 l\u2019emploi propos\u00e9 le n\u00e9cessite, ou toute autre information r\u00e9ellement pertinente au regard des caract\u00e9ristiques du poste.<\/p>\n<p>De m\u00eame, <strong>certaines discriminations sont exceptionnellement permises\u00a0<\/strong>: la prise en compte du sexe du candidat est admise dans certains domaines artistiques, et la restriction en fonction de l\u2019\u00e2ge du candidat est \u00e9galement possible d\u00e8s lors qu\u2019elle est justifi\u00e9e et proportionn\u00e9e.<\/p>\n<p>Quant aux techniques de graphologies ou d\u2019astrologie, aussi discutables qu\u2019elles puissent para\u00eetre,\u00a0 elles ne sont pas interdites si elles respectent les principes g\u00e9n\u00e9raux \u00e9voqu\u00e9s pr\u00e9c\u00e9demment.<\/p>\n<p>Enfin, il faut rappeler que<strong> le simple fait pour l\u2019employeur de poser des questions prohib\u00e9es caract\u00e9rise une discrimination, passible de sanctions civiles et p\u00e9nales\u00a0<\/strong>: le candidat peut donc refuser d\u2019y r\u00e9pondre et <a href=\"https:\/\/www.legalife.fr\/consulter-un-avocat\" target=\"_blank\" rel=\"noopener\">consulter un avocat<\/a> en vue de saisir le tribunal civil ou r\u00e9pressif.<\/p>\n<p>Toutefois, si la demande d\u2019information est pertinente est justifi\u00e9e, le fait pour le candidat d\u2019effectuer une fausse d\u00e9claration peut justifier la rupture ult\u00e9rieure du <a href=\"http:\/\/www.gereso.com\/formations\/droit-du-travail\/formation-les-contrats-de-travail\">contrat de travail<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>L\u2019entretien d\u2019embauche est un moment crucial pour le candidat comme pour l\u2019employeur.
