Une faute commise par un salari\u00e9 ne peut donner lieu, \u00e0 elle seule, \u00e0 l\u2019engagement de <strong><a href=\"http:\/\/www.gereso.com\/formations\/droit-du-travail\/formation-procedure-disciplinaire-et-contentieux-prud-homal\" target=\"_blank\">poursuites disciplinaires<\/a><\/strong> au-del\u00e0 d\u2019un d\u00e9lai de 2 mois \u00e0 compter du jour o\u00f9 l\u2019employeur en a eu connaissance.\u00a0 <a href=\"http:\/\/rfpaye.grouperf.com\/lien_spad\/?base=LEGI&amp;orig=REVUE_RF_FH&amp;code=LEGITEXT000006072050&amp;numero=L1332-4&amp;idspad=LEGIARTI000006901450\" target=\"_blank\" rel=\"nofollow\">Art. L. 1332-4 <\/a>du code du travail.<\/em><\/p>\n<p>Une affaire jug\u00e9e par la Cour de cassation le 17 juin 2015 donne \u00e0 voir le cas d\u2019une salari\u00e9e qui assumait des fonctions de coordinatrice au sein d\u2019une cr\u00e8che et qui avait \u00e9t\u00e9 licenci\u00e9e \u00e0 la suite d\u2019<strong>un contr\u00f4le de la caisse d\u2019allocations familiales<\/strong> (CAF). Le 1<sup>er<\/sup> mars 2010, <a href=\"http:\/\/www.gereso.com\/formations\/comptabilite-fiscalite-gestion-financiere\/\" target=\"_blank\">les services de la CAF avaient proc\u00e9d\u00e9 \u00e0 un contr\u00f4le<\/a> sur site portant sur l\u2019ann\u00e9e 2008. Ce contr\u00f4le, qui relevait de nombreuses <strong>anomalies et carences de gestion imputables aux n\u00e9gligences de la salari\u00e9e<\/strong>, avait donn\u00e9 lieu \u00e0 un redressement et \u00e0 un rapport \u00e9crit transmis le 17 mai 2010 \u00e0 l\u2019employeur.<\/p>\n<p>Le 20 mai 2010, la salari\u00e9e avait \u00e9t\u00e9 convoqu\u00e9e \u00e0 un <strong>entretien pr\u00e9alable<\/strong> puis avait \u00e9t\u00e9 licenci\u00e9e pour faute grave. Pour la salari\u00e9e, son <strong>licenciement<\/strong> \u00e9tait <strong>abusif<\/strong> dans la mesure o\u00f9 son employeur avait eu connaissance des faits qu\u2019il lui reprochait \u00e0 une date ant\u00e9rieure \u00e0 la transmission du rapport de la CAF, de sorte que ces faits \u00e9taient prescrits.<\/p>\n<p>Mais pour la Cour de cassation, les juges du fond avaient bien fait ressortir que l\u2019employeur ne pouvait avoir eu une connaissance exacte des faits reproch\u00e9s avant le 17 mai 2010. Ainsi, au moment de l\u2019engagement de la proc\u00e9dure disciplinaire le 20 mai, les faits n\u2019\u00e9taient pas prescrits. <strong>Le licenciement \u00e9tait donc valable<\/strong>.\u00a0\u00a0 <em>Cass. soc. 17 juin 2015, n\u00b0 <a href=\"http:\/\/rfpaye.grouperf.com\/lien_spad\/?base=JURI&amp;orig=REVUE_RF_FH&amp;juridiction=CASS&amp;chambre=SOC.&amp;numero=14-10865&amp;sp=\/juri\/inca\/global\/sociale\/JURI\/TEXT\/00\/00\/30\/76\/30\/JURITEXT000030763053.xml&amp;date=2015-06-17\" target=\"_blank\" rel=\"nofollow\">14-10865<\/a> D<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Prescription des fautes disciplinaires : prise en compte de la date \u00e0 laquelle l\u2019employeur en a eu une connaissance exacte.
