{"id":4363,"date":"2015-07-21T09:37:15","date_gmt":"2015-07-21T07:37:15","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=4363"},"modified":"2015-07-21T09:37:15","modified_gmt":"2015-07-21T07:37:15","slug":"duree-du-travail-la-preuve-des-temps-de-pauses-incombe-exclusivement-a-lemployeur","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2015\/07\/21\/duree-du-travail-la-preuve-des-temps-de-pauses-incombe-exclusivement-a-lemployeur\/","title":{"rendered":"Dur\u00e9e du travail : la preuve des temps de pauses incombe exclusivement \u00e0 l\u2019employeur"},"content":{"rendered":"<p>Dans un arr\u00eat jug\u00e9 le 18 juin 2015, la Cour de cassation s\u2019est pench\u00e9e sur le cas d\u2019une salari\u00e9e qui avait saisi les prud\u2019hommes d\u2019une demande de rappel de salaire relative \u00e0 des<strong> temps de pause<\/strong> qu\u2019elle affirmait n\u2019avoir jamais pris.<\/p>\n<p>Une cour d\u2019appel avait<strong> oppos\u00e9 un refus<\/strong>, car elle estimait que, face \u00e0 la contestation de l\u2019employeur qui soutenait que la salari\u00e9e b\u00e9n\u00e9ficiait bien de ses pauses, celle-ci n\u2019apportait aucun \u00e9l\u00e9ment pouvant \u00e9tablir qu\u2019elle n\u2019avait pas pris ses <a href=\"http:\/\/www.gereso.com\/fonction-publique\/formation-plannings-et-gestion-du-temps-de-travail-dans-la-fonction-publique-hospitaliere\" target=\"_blank\">temps de pause<\/a>. Mais pour la Cour de cassation la preuve du <strong>respect des temps de pause<\/strong> n\u2019incombe qu\u2019\u00e0 l\u2019employeur.<\/p>\n<p>Les juges de la cour d\u2019appel ayant invers\u00e9 la charge de la preuve (c. trav. <a href=\"http:\/\/rfpaye.grouperf.com\/lien_spad\/?base=LEGI&amp;orig=REVUE_RF_FH&amp;code=LEGITEXT000006072050&amp;numero=L3121-33&amp;idspad=LEGIARTI000006902472\" target=\"_blank\" rel=\"nofollow\">art. L. 3121-33<\/a> ; c. civ. art <a href=\"http:\/\/rfpaye.grouperf.com\/lien_spad\/?base=LEGI&amp;orig=REVUE_RF_FH&amp;code=LEGITEXT000006070721&amp;numero=1315&amp;idspad=LEGIARTI000006437767\" target=\"_blank\" rel=\"nofollow\">1315<\/a>), leur arr\u00eat est annul\u00e9 et l\u2019affaire sera rejug\u00e9e. La Cour de cassation rappelle ainsi que<strong> les dispositions du code du travail<\/strong> relatives au partage de la charge de la preuve des heures de travail accomplies entre l&#8217;employeur et le salari\u00e9 (c. trav. <a href=\"http:\/\/rfpaye.grouperf.com\/lien_spad\/?base=LEGI&amp;orig=REVUE_RF_FH&amp;code=LEGITEXT000006072050&amp;numero=L3171-4&amp;idspad=LEGIARTI000006902808\" target=\"_blank\" rel=\"nofollow\">art.
