Or, dans un arr\u00eat du 3 juin dernier, la haute juridiction pr\u00e9cise que <strong>l\u2019emploi, pr\u00e9c\u00e9demment occup\u00e9, peut ne plus \u00eatre disponible<\/strong> si l\u2019employeur, dans le cadre de ses pouvoirs d\u2019organisation et de direction, a d\u00e9cid\u00e9 de remplacer \u00e0 titre d\u00e9finitif la personne absente, via un recrutement ou une <a href=\"http:\/\/www.gereso.com\/formations\/ressources-humaines\/formation-entretien-de-mobilite-interne\" target=\"_blank\">mobilit\u00e9 interne<\/a>.<\/p>\n<p>Ainsi, en l\u2019esp\u00e8ce, une salari\u00e9e, \u00e0 l\u2019issue d\u2019un cong\u00e9 sabbatique de 11 mois, n\u2019a pu retrouver son poste de responsable clients, celui-ci ayant \u00e9t\u00e9 d\u00e9finitivement pourvu dans le cadre d\u2019une mobilit\u00e9 interne. D\u2019autres postes lui ont alors \u00e9t\u00e9 propos\u00e9s mais qu\u2019elle a tous refus\u00e9s, les jugeant non similaires, eu \u00e9gard au lieu de travail et \u00e0 la perte de certains avantages comme l\u2019int\u00e9ressement, entrainant donc son<strong> <a href=\"http:\/\/www.gereso.com\/formations\/droit-du-travail\/formation-rupture-du-contrat-de-travail\" target=\"_blank\">licenciement <\/a>pour motif personnel<\/strong>.<\/p>\n<p>Or, les juges du fond puis la Cour de cassation ont estim\u00e9 que les emplois propos\u00e9s (responsable merchandising, responsable pr\u00e9visions, charg\u00e9 d\u2019\u00e9tude de prix)\u00a0 pr\u00e9sentaient des caract\u00e9ristiques \u00e9quivalentes <strong>en terme de formation<\/strong>, de capacit\u00e9 manag\u00e9riales, de connaissances en marketing et merchandising ainsi que de la maitrise de l\u2019anglais et des outils bureautiques qu\u2019ils supposaient.<\/p>\n<p>Il appartient donc au salari\u00e9 de faire des compromis car la notion de poste similaire ne suppose pas que<strong> les conditions de travail<\/strong> et la nature des fonctions soient identiques mais seulement \u00e9quivalentes en terme de connaissances et d\u2019aptitude avec un maintien de la qualification.
