Or, le non respect de <strong>cette protection\u00a0entra\u00eene\u00a0la nullit\u00e9 d\u2019un \u00e9ventuel licenciement<\/strong>. Ainsi, en l\u2019esp\u00e8ce, le responsable d\u2019une agence immobili\u00e8re a \u00e9t\u00e9 licenci\u00e9 pour diff\u00e9rents motifs, \u00e0 savoir, le non respect des horaires, des r\u00e9sultats insuffisants, un manque de coordination et de respect de son \u00e9quipe.<\/p>\n<p>A cela, l\u2019employeur ajoute dans <strong>la <a href=\"http:\/\/www.gereso.com\/formations\/droit-du-travail\/formation-procedure-disciplinaire-et-contentieux-prud-homal\" target=\"_blank\">lettre de licenciement<\/a><\/strong>\u00a0: <em>\u00ab\u00a0vous n\u2019h\u00e9sitez pas \u00e0 m\u2019accuser de harc\u00e8lement alors que je vous demande tout simplement de faire votre travail correctement\u00bb<\/em>. Cette seule phrase permet au salari\u00e9 d\u2019obtenir <strong>la nullit\u00e9 de son licenciement<\/strong> dans la mesure o\u00f9 elle permet d\u2019\u00e9tablir le statut de salari\u00e9 prot\u00e9g\u00e9 sans que l\u2019employeur ne r\u00e9ussisse \u00e0 \u00e9tablir sa mauvaise foi qui ne peut r\u00e9sulter de sa seule volont\u00e9 d\u2019emp\u00eacher l\u2019employeur d\u2019exercer son pouvoir de direction, d\u2019organisation et de contr\u00f4le.
