{"id":4958,"date":"2016-02-22T09:14:19","date_gmt":"2016-02-22T08:14:19","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=4958"},"modified":"2016-02-22T09:12:19","modified_gmt":"2016-02-22T08:12:19","slug":"licenciement-disciplinaire-et-delai-daction","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/02\/22\/licenciement-disciplinaire-et-delai-daction\/","title":{"rendered":"Licenciement disciplinaire et d\u00e9lai d&rsquo;action"},"content":{"rendered":"<p>Un employeur a le droit de sanctionner des manquements du salari\u00e9 aux r\u00e8gles impos\u00e9es \u00e0 la collectivit\u00e9 de travail dans l\u2019entreprise.<\/p>\n<p>L\u2019article L.1332-4 du code de travail pr\u00e9cise que : \u00ab Aucun fait fautif ne peut donner lieu \u00e0 lui seul \u00e0 l&rsquo;engagement de poursuites disciplinaires au-del\u00e0 d&rsquo;un d\u00e9lai de deux mois \u00e0 compter du jour o\u00f9 l&#8217;employeur en a eu connaissance, \u00e0 moins que ce fait ait donn\u00e9 lieu dans le m\u00eame d\u00e9lai \u00e0 l&rsquo;exercice de poursuites p\u00e9nales \u00bb. La proc\u00e9dure disciplinaire doit alors \u00eatre engag\u00e9e dans les deux mois suivant la connaissance des faits.<\/p>\n<p>Lors de l\u2019affaire jug\u00e9e le 13 janvier 2016 en Cours de cassation, les juges se sont pench\u00e9s sur la notification de licenciement pour une cause s\u00e9rieuse et r\u00e9elle, d\u00e9pourvue de caract\u00e8re disciplinaire. La lettre pr\u00e9cisait les probl\u00e8mes g\u00e9n\u00e9r\u00e9s par le comportement du salari\u00e9 : \u00ab Nuisait au bon climat du service et portait atteinte aux personnes et aux valeurs de l\u2019entreprise et g\u00e9n\u00e9rait des d\u00e9sorganisations au niveau de l\u2019agence et du service \u00bb.<\/p>\n<p>Pour les juges, le licenciement avait \u00e9t\u00e9 prononc\u00e9 pour des motifs disciplinaires.
