{"id":5221,"date":"2016-03-28T19:55:22","date_gmt":"2016-03-28T18:55:22","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=5221"},"modified":"2016-03-23T11:08:37","modified_gmt":"2016-03-23T10:08:37","slug":"la-cour-de-cassation-considere-comme-irrecevable-le-changement-de-strategie-adopte-par-un-salarie-defendant-son-licenciement-pour-inaptitude","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/03\/28\/la-cour-de-cassation-considere-comme-irrecevable-le-changement-de-strategie-adopte-par-un-salarie-defendant-son-licenciement-pour-inaptitude\/","title":{"rendered":"La Cour de cassation consid\u00e8re comme irrecevable le changement de strat\u00e9gie adopt\u00e9 par un salari\u00e9 d\u00e9fendant son licenciement pour inaptitude"},"content":{"rendered":"<p style=\"text-align: justify;\">La <a href=\"http:\/\/circulaire.legifrance.gouv.fr\/pdf\/2012\/08\/cir_35638.pdf\" target=\"_blank\" rel=\"nofollow\">circulaire DGT 2012-7 du 30 juillet 2012<\/a>, dans sa fiche 10, pr\u00e9cise que\u00a0\u00ab\u00a0dans le cadre d\u2019un licenciement pour inaptitude physique, l\u2019autorit\u00e9 administrative, c\u2019est-\u00e0-dire l\u2019inspecteur du travail, doit s\u2019assurer\u00a0:<\/p>\n<ul style=\"text-align: justify;\">\n<li>du respect, applicable \u00e0 tout motif, de la<strong> r\u00e9gularit\u00e9 de la proc\u00e9dure<\/strong> sp\u00e9cifique en plus de la r\u00e9gularit\u00e9 de la proc\u00e9dure interne \u00e0 l\u2019entreprise\u00a0;<\/li>\n<li>Du <strong>caract\u00e8re r\u00e9el et s\u00e9rieux<\/strong> des efforts de reclassement\u00a0;<\/li>\n<li>De <strong>l\u2019absence de lien<\/strong> avec le mandat ou l\u2019appartenance syndicale\u00a0;<\/li>\n<li>De<strong> l\u2019absence de motif d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral<\/strong> s\u2019opposant au licenciement.\u00a0\u00bb<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Partant de l\u2019hypoth\u00e8se o\u00f9 l\u2019inaptitude est caus\u00e9e par un harc\u00e8lement, l\u2019employ\u00e9 voulant \u00eatre d\u00e9dommag\u00e9 et percevoir des int\u00e9r\u00eats, voire m\u00eame la nullit\u00e9 de la rupture, doit saisir le juge judiciaire et non le juge administratif (CE 20 novembre 2013, n\u00b0 340591 ; Cass. soc. 27 novembre 2013, n\u00b0 12-20301, BC V n\u00b0 286 ; CE 7 novembre 2014, n\u00b0 371116 ; Cass. soc. 15 avril 2015, n\u00b0 13-21306 FSPB)<\/p>\n<p style=\"text-align: justify;\">Dans une affaire r\u00e9cente, les juges ont appliqu\u00e9 cette d\u00e9cision. Le litige se rapportait \u00e0 une d\u00e9l\u00e9gu\u00e9e du personnel, en mauvais termes avec son employeur, pour des raisons d\u2019utilisation des v\u00e9hicules de fonction. Face \u00e0 ce probl\u00e8me, l\u2019int\u00e9ress\u00e9e a d\u00e9cid\u00e9 de <strong>r\u00e9silier son contrat de travail<\/strong>, aupr\u00e8s de la juridiction comp\u00e9tente. En m\u00eame temps, le m\u00e9decin de travail a d\u00e9clar\u00e9 son inaptitude \u00e0 tout poste, suite \u00e0 un arr\u00eat maladie. L\u2019employeur l\u2019avait alors licenci\u00e9, apr\u00e8s appr\u00e9ciation de l\u2019inspection du travail.<\/p>\n<p style=\"text-align: justify;\">Un premier arr\u00eat avait \u00e9t\u00e9 rendu dans cette affaire. La Cour avait estim\u00e9 que \u00ab\u00a0<em>le principe de s\u00e9paration des pouvoirs emp\u00eache la salari\u00e9e de demander, devant le juge judiciaire, la r\u00e9paration de la perte de son emploi et de l&rsquo;incidence sur sa retraite, quand celle-ci faisait valoir que ce pr\u00e9judice r\u00e9sultait du harc\u00e8lement moral pratiqu\u00e9 par l&#8217;employeur et \u00e0 l&rsquo;origine de son inaptitude professionnelle, dont l&rsquo;existence a \u00e9t\u00e9 constat\u00e9e.\u00a0<\/em>\u00bb (<a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?idTexte=JURITEXT000028012354\" target=\"_blank\" rel=\"nofollow\">Cass.
