{"id":5647,"date":"2016-04-06T10:10:31","date_gmt":"2016-04-06T09:10:31","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=5647"},"modified":"2016-04-04T15:11:46","modified_gmt":"2016-04-04T14:11:46","slug":"syndicat-sanction-employeur","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/04\/06\/syndicat-sanction-employeur\/","title":{"rendered":"Un syndicat peut-il faire sanctionner un employeur pour un recours abusif au CDD ?"},"content":{"rendered":"<p>Selon l\u2019article L 2132-3, les syndicats sont recevables \u00e0 demander l\u2019ex\u00e9cution d\u2019une disposition d\u2019une convention ou d\u2019un accord collectif dans\u00a0la mesure o\u00f9 son inapplication cause n\u00e9cessairement un pr\u00e9judice \u00e0 l\u2019int\u00e9r\u00eat collectif de la profession.<\/p>\n<p>En l\u2019esp\u00e8ce, il s\u2019agissait de savoir si l\u2019article de la convention collective de l\u2019h\u00f4tellerie pr\u00e9voyant la <strong>requalification d\u2019un CDD\u00a0d\u2019usage en CDI\u00a0au-del\u00e0 de 60 jours de missions<\/strong> dans un trimestre civil, relevait seulement de l\u2019int\u00e9r\u00eat individuel ou pouvait aussi, en cas de non application, porter atteinte \u00e0 l\u2019int\u00e9r\u00eat collectif de la profession.<\/p>\n<p>En effet, dans cette affaire, un salari\u00e9, embauch\u00e9 en 2007 comme cuisinier par un CDD\u00a0\u00e0 temps partiel, a engag\u00e9 une action devant le Conseil de prud\u2019hommes pour obtenir la requalification de la relation de travail dans la mesure o\u00f9 celle-ci s\u2019est poursuivie pour des missions ponctuelles jusqu\u2019en 2011. Or, l\u2019union locale CGT a d\u00e9cid\u00e9 d\u2019intervenir \u00e0 l\u2019instance pour faire sanctionner, par le biais d\u2019une condamnation s\u00e9par\u00e9e, l\u2019employeur qui en ayant recours \u00e0 des CDD\u00a0d\u2019usage pour occuper un emploi permanent <strong>a port\u00e9 atteinte \u00e0 l\u2019int\u00e9r\u00eat collectif de la profession<\/strong>.<\/p>\n<p>Le conseil de prud\u2019hommes a fait droit aux demandes du salari\u00e9 et du syndicat.
