{"id":5683,"date":"2016-04-08T12:45:52","date_gmt":"2016-04-08T11:45:52","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=5683"},"modified":"2016-04-04T15:18:55","modified_gmt":"2016-04-04T14:18:55","slug":"reclassement-inaptitude-professionnelle","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/04\/08\/reclassement-inaptitude-professionnelle\/","title":{"rendered":"Modalit\u00e9s du reclassement en cas d&rsquo;inaptitude professionnelle"},"content":{"rendered":"<p><strong>Les difficult\u00e9s \u00e0 appliquer la dispense de recherche de reclassement en cas de constat d\u2019inaptitude d\u2019origine professionnelle si le m\u00e9decin du travail estime que \u00ab\u00a0le maintien du salari\u00e9 dans l\u2019entreprise serait pr\u00e9judiciable \u00e0 sa sant\u00e9\u00a0\u00bb, facult\u00e9 introduite par la loi Rebsamen. \u00a0 \u00a0 \u00a0 \u00a0\u00a0<\/strong><\/p>\n<p>Jusqu&rsquo;\u00e0 maintenant, selon le code du travail et de tr\u00e8s nombreux arr\u00eats, lorsque le m\u00e9decin du travail constatait l&rsquo;inaptitude au poste, la jurisprudence exigeait que l&#8217;employeur <strong>recherche un poste de reclassement<\/strong>, y compris si le m\u00e9decin du travail pr\u00e9cisait dans l&rsquo;avis d&rsquo;inaptitude, que le salari\u00e9 \u00e9tait inapte \u00e0 tout poste dans l&rsquo;entreprise. Par ailleurs, dans les entreprises d&rsquo;au moins 50 salari\u00e9s, le m\u00e9decin peut formuler des pr\u00e9conisations en mati\u00e8re de formation pour permettre la proposition d\u2019un poste plus adapt\u00e9,\u00a0sachant que la d\u00e9cision finale et l&rsquo;initiative des formations et transformations de poste rel\u00e8vent int\u00e9gralement de l&#8217;employeur, seul responsable.<\/p>\n<p>D\u00e9sormais, si l&rsquo;on consid\u00e8re que l&rsquo;avis d&rsquo;inaptitude mentionnant que le \u00ab\u00a0maintien du salari\u00e9 dans l&rsquo;entreprise serait gravement pr\u00e9judiciable \u00e0 sa sant\u00e9 \u00a0\u00bb est un motif autonome de licenciement, totalement distinct de celui de l&rsquo;impossibilit\u00e9 de reclassement, <strong>il est permis \u00e0 l\u2019employeur de se reposer uniquement sur l&rsquo;avis m\u00e9dical<\/strong> pour rompre le contrat.<\/p>\n<p>Or, le texte ne visant que l\u2019entreprise et non le groupe, on peut se demander si l\u2019employeur est aussi dispens\u00e9 d\u2019une recherche de reclassement lorsque l\u2019entreprise s\u2019inscrit dans un groupe.
