Aussi, apr\u00e8s un avertissement rest\u00e9 sans effet, il a fait appel \u00e0 une soci\u00e9t\u00e9 d&rsquo;audit pour v\u00e9rifier le travail de l&rsquo;int\u00e9ress\u00e9e qui a confirm\u00e9 les d\u00e9rapages de la salari\u00e9e entra\u00eenant son <strong>licenciement\u00a0pour faute grave<\/strong>.<\/p>\n<p>Or, la salari\u00e9e a fait valoir l&rsquo;article L 1222-4 pour contester cette sanction\u00a0selon lequel\u00a0\u00ab\u00a0aucune information concernant personnellement un salari\u00e9 ne peut \u00eatre collect\u00e9e par un dispositif qui n&rsquo;a pas \u00e9t\u00e9 pr\u00e9alablement port\u00e9 \u00e0 sa connaissance\u00a0\u00bb.<\/p>\n<p>N\u00e9anmoins, la Cour de cassation va estimer que \u00ab\u00a0si la salari\u00e9e n&rsquo;a pas \u00e9t\u00e9 pr\u00e9alablement inform\u00e9e de la mission confi\u00e9e par l&#8217;employeur \u00e0 une soci\u00e9t\u00e9 d&rsquo;expertise comptable, elle n&rsquo;a pas \u00e9t\u00e9 tenue \u00e0 l&rsquo;\u00e9cart des travaux r\u00e9alis\u00e9s les 6 et 25 juin 2012, aux fins d&rsquo;entretiens avec l&rsquo;int\u00e9ress\u00e9e et de sondage sur des pi\u00e8ces comptables ou juridiques\u00a0\u00bb.
