Il doit ainsi lui proposer un autre emploi appropri\u00e9 \u00e0 ses capacit\u00e9s.<\/p>\n<p><em>Code du travail <a href=\"http:\/\/rfpaye.grouperf.com\/lien_spad\/?base=LEGI&amp;orig=REVUE_RF_FH&amp;code=LEGITEXT000006072050&amp;numero=L1226-2&amp;idspad=LEGIARTI000006900966\" target=\"_blank\" rel=\"nofollow\">articles L. 1226-2<\/a> et <a href=\"http:\/\/rfpaye.grouperf.com\/lien_spad\/?base=LEGI&amp;orig=REVUE_RF_FH&amp;code=LEGITEXT000006072050&amp;numero=L1226-10&amp;idspad=LEGIARTI000025579028\">L. 1226-10<\/a><\/em><\/p>\n<p>Un salari\u00e9 occupant le poste de manager du d\u00e9partement boucherie avait \u00e9t\u00e9 d\u00e9clar\u00e9 inapte \u00e0 son poste \u00e0 la suite d\u2019un arr\u00eat de travail pour maladie non professionnelle. Il avait \u00e9t\u00e9 licenci\u00e9 pour inaptitude et impossibilit\u00e9 de reclassement apr\u00e8s avoir refus\u00e9 des postes conformes aux pr\u00e9conisations du m\u00e9decin du travail et disponibles que lui avait propos\u00e9 l\u2019employeur, par oral, lors d&rsquo;une r\u00e9union avec les d\u00e9l\u00e9gu\u00e9s du personnel.<\/p>\n<p>La cour d\u2019appel a consid\u00e9r\u00e9 que l\u2019employeur avait manqu\u00e9 \u00e0 son obligation de reclassement en ne faisant pas ses propositions par \u00e9crit. Mais, la Cour de cassation n\u2019a pas \u00e9t\u00e9 du m\u00eame avis. Selon elle, <strong>les propositions de reclassement n&rsquo;ont pas \u00e0 \u00eatre effectu\u00e9es par \u00e9crit<\/strong>, m\u00eame si l&#8217;employeur a, en pratique, int\u00e9r\u00eat \u00e0 se m\u00e9nager une preuve de son offre.<\/p>\n<p>En reprochant \u00e0 l&#8217;employeur de ne pas avoir fait de proposition \u00e9crite, la cour d\u2019appel a ainsi ajout\u00e9 \u00e0 la loi une condition qu\u2019elle ne pr\u00e9voit pas.
