{"id":5943,"date":"2016-05-03T16:45:22","date_gmt":"2016-05-03T14:45:22","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=5943"},"modified":"2016-05-02T17:21:56","modified_gmt":"2016-05-02T15:21:56","slug":"avantages-conventionnels-categoriels","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/05\/03\/avantages-conventionnels-categoriels\/","title":{"rendered":"Avantages conventionnels cat\u00e9goriels : les conditions d&rsquo;application"},"content":{"rendered":"<p>Une d\u00e9cision r\u00e9cente vient sp\u00e9cifier\u00a0que lorsqu&rsquo;il existe des avantages conventionnels cat\u00e9goriels, c\u2019est au cadre de d\u00e9montrer pourquoi il aurait droit \u00e0 un avantage conventionnel pr\u00e9vu pour les non-cadres.<\/p>\n<p>Un \u00e9tablissement de sant\u00e9 versait \u00e0 son personnel, en application de la convention collective, une <strong>prime d\u2019exp\u00e9rience professionnelle<\/strong> dont les modalit\u00e9s de calcul variaient selon que les salari\u00e9s \u00e9taient cadres ou non-cadres. Un cadre demandait \u00e0 b\u00e9n\u00e9ficier du mode de calcul pr\u00e9vu pour les non-cadres.<\/p>\n<p>La cour d\u2019appel avait rejet\u00e9 ses pr\u00e9tentions, au motif notamment que les modalit\u00e9s de calcul appliqu\u00e9es aux non-cadres s\u2019expliquaient par les conditions particuli\u00e8res d\u2019exercice de cette cat\u00e9gorie de salari\u00e9s qui comportait, pour l\u2019essentiel, des soignants.<\/p>\n<p>La Cour de cassation confirme cette argumentation. Elle rappelle que les diff\u00e9rences de traitement entre cat\u00e9gories professionnelles op\u00e9r\u00e9es par voie de conventions ou d&rsquo;accords collectifs sont pr\u00e9sum\u00e9es justifi\u00e9es. <strong>Il appartient donc au salari\u00e9 qui les conteste de d\u00e9montrer qu&rsquo;elles sont \u00e9trang\u00e8res \u00e0 toute consid\u00e9ration de nature professionnelle<\/strong>.<\/p>\n<p><em>Cass. soc. 27 janvier 2015, n\u00b0 <a href=\"http:\/\/rfpaye.grouperf.com\/lien_spad\/?base=JURI&amp;orig=REVUE_RF_FH&amp;juridiction=CASS&amp;chambre=SOC.&amp;numero=13-22179&amp;sp=\/juri\/cass\/global\/sociale\/JURI\/TEXT\/00\/00\/30\/17\/48\/JURITEXT000030174876.xml&amp;date=2015-01-27\" target=\"_blank\" rel=\"nofollow\">13-22179<\/a>, BC V n\u00b0 9<\/em><\/p>\n<p>Or, dans cette affaire, le salari\u00e9 n\u2019avait pas apport\u00e9 cette preuve. \u00c0 l\u2019inverse, la cour d\u2019appel avait constat\u00e9 que la diff\u00e9rence de traitement entre cadres et non-cadres n&rsquo;\u00e9tait pas \u00e9trang\u00e8re \u00e0 toute consid\u00e9ration de nature professionnelle.<\/p>\n<p>Pour la petite histoire, le cadre verra tout de m\u00eame son affaire rejug\u00e9e, mais sur le fondement de la <strong>discrimination<\/strong>. En effet, l\u2019employeur n\u2019avait pas jug\u00e9 utile de le faire b\u00e9n\u00e9ficier de formations, au pr\u00e9texte que les fonctions \u00e9lectives de l\u2019int\u00e9ress\u00e9, titulaire de plusieurs mandats, occupaient 100 % de son temps de travail.
