{"id":6400,"date":"2016-06-17T08:35:01","date_gmt":"2016-06-17T06:35:01","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=6400"},"modified":"2017-12-22T13:02:10","modified_gmt":"2017-12-22T11:02:10","slug":"cotisations-sociales-mai-2016","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/06\/17\/cotisations-sociales-mai-2016\/","title":{"rendered":"Cotisations sociales : ce qui change depuis mai 2016"},"content":{"rendered":"<h2>Nouvelle d\u00e9nomination de la contribution patronale au financement des organisations syndicales<\/h2>\n<p>Les entreprises sont redevables depuis le 1<sup>er<\/sup> janvier 2015 d&rsquo;une <strong>contribution patronale de 0,016%<\/strong> , au profit d&rsquo;un fonds paritaire destin\u00e9 \u00e0 financer les syndicats d&#8217;employeurs et de salari\u00e9s.<\/p>\n<p><em>Source &#8211; Art D 2135-34 du Code du travail<\/em><\/p>\n<p>La loi n\u00b02014-288 du 5 mars 2014 relative \u00e0 la formation professionnelle, \u00e0 l&#8217;emploi et \u00e0 la d\u00e9mocratie sociale a, en effet, pr\u00e9vu la constitution d&rsquo;un<strong> fonds de financement des organisations professionnelles d&#8217;employeurs et des organisations syndicales de salari\u00e9s<\/strong>. Les ressources de ce fonds comprennent notamment cette contribution pr\u00e9lev\u00e9e sur l&rsquo;ensemble des employeurs priv\u00e9s (entreprises priv\u00e9es et salari\u00e9s des entreprises publiques employ\u00e9s dans les conditions du droit priv\u00e9).<\/p>\n<p>Cette contribution due sur la totalit\u00e9 du salaire est <strong>contr\u00f4l\u00e9e et pr\u00e9lev\u00e9e par les URSSAF<\/strong> (ou CGSS), selon les m\u00eames r\u00e8gles et sous les m\u00eames garanties et sanctions que celles applicables au recouvrement des cotisations du r\u00e9gime g\u00e9n\u00e9ral de la s\u00e9curit\u00e9 sociale.<\/p>\n<p>L\u2019URSSAF indique, dans une information publi\u00e9e sur son site Internet le 9 mai 2016, que la d\u00e9nomination de cette contribution change. <strong>Elle est d\u00e9sormais d\u00e9nomm\u00e9e \u00ab contribution au dialogue social \u00bb<\/strong>. En revanche, le code type de personnel \u00e0 utiliser pour d\u00e9clarer cette contribution demeure inchang\u00e9. Pour les employeurs de droit priv\u00e9, il s\u2019agit toujours du CTP 027.<\/p>\n<h2>Contr\u00f4le URSSAF : de l&rsquo;importance d&rsquo;une convention de r\u00e9ciprocit\u00e9 en cas de d\u00e9l\u00e9gation<\/h2>\n<p>Selon les art L 213-1 et D 213-1-1 du code de la s\u00e9curit\u00e9 sociale, une URSSAF peut d\u00e9l\u00e9guer \u00e0 une autre ses comp\u00e9tences en adh\u00e9rant \u00e0 une <strong>convention g\u00e9n\u00e9rale de r\u00e9ciprocit\u00e9<\/strong> \u00e9tablie par le directeur de l\u2019ACOSS.<\/p>\n<p>La Cour de cassation rappelle, dans un arr\u00eat du 4 mai 2016, que l\u2019avis pr\u00e9alable au contr\u00f4le doit \u00eatre adress\u00e9 \u00e0 l\u2019entreprise apr\u00e8s la signature de la convention de r\u00e9ciprocit\u00e9.<\/p>\n<p>Dans le cas d\u2019esp\u00e8ce, il avait \u00e9t\u00e9 adress\u00e9 \u00e0 la soci\u00e9t\u00e9 avant la signature de la convention de r\u00e9ciprocit\u00e9, ce dont il r\u00e9sultait que l\u2019URSSAF n\u2019\u00e9tait pas comp\u00e9tente \u00e0 cette date pour proc\u00e9der aux op\u00e9rations de contr\u00f4le de la soci\u00e9t\u00e9.<\/p>\n<p><em>Source &#8211; Art R 243-59 du code de la S\u00e9curit\u00e9 sociale<\/em><\/p>\n<p><strong>Lorsque \u00a0la proc\u00e9dure n\u2019est pas respect\u00e9e, le contr\u00f4le est nul<\/strong> et le redressement \u00e9ventuellement op\u00e9r\u00e9 caduque.<\/p>\n<p><em>Sources &#8211; Cassation 2e ch., 12 juillet 2006, n\u00b004-30844 BC II n\u00b0 191 ;\u00a0Cassation. Civile , 2e ch., 4 mai 2016, n\u00b0 15-18188<\/em><\/p>\n<h2>Exon\u00e9ration de cotisations sociales dans les DOM<\/h2>\n<p>Un d\u00e9cret du 9 mai 2016 \u00e9tablit les nouvelles formules de calcul des exon\u00e9rations de cotisations sociales dans les DOM.<\/p>\n<p>Le d\u00e9cret d\u00e9finit les formules de calcul permettant de d\u00e9terminer le <strong>montant des exon\u00e9rations de cotisations sociales<\/strong> applicables aux entreprises situ\u00e9es en outre-mer \u00e0 compter du 1<sup>er<\/sup> janvier 2016.<\/p>\n<p>Dans le but de concentrer les exon\u00e9rations de cotisations patronales d\u2019assurances sociales applicables aux entreprises situ\u00e9es dans ces zones g\u00e9ographiques (Guadeloupe, Guyane, Martinique, La R\u00e9union, Saint-Barth\u00e9lemy et Saint-Martin) vers les plus bas salaires, la loi de financement de la s\u00e9curit\u00e9 sociale pour 2016 a modifi\u00e9 l\u2019ensemble des seuils d\u2019exon\u00e9ration de cotisations sociales de ces entreprises.<\/p>\n<p>C\u2019est dans ce cadre que <strong>le d\u00e9cret du 9 mai 2016 pr\u00e9cise les formules de calcul permettant de d\u00e9terminer le montant de ces all\u00e8gements<\/strong>.<\/p>\n<p>Par ailleurs, le d\u00e9cret modifie certaines dispositions r\u00e9glementaires relatives \u00e0 la protection sociale des non-salari\u00e9s dans les DOM, afin de tenir compte de la cr\u00e9ation d\u2019une cotisation d\u2019assurance invalidit\u00e9 ind\u00e9pendante de la cotisation maladie et maternit\u00e9.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nouvelle d\u00e9nomination de la contribution patronale au financement des organisations syndicales Les entreprises sont redevables depuis le 1er janvier 2015 d&rsquo;une contribution patronale de 0,016% , au profit d&rsquo;un fonds paritaire destin\u00e9 \u00e0 financer les syndicats d&#8217;employeurs et de salari\u00e9s.
