Mais les juges du fond ne partagent pas cette position et requalifient le contrat initial en contrat de travail \u00e0 temps plein, l\u2019avenant n\u2019ayant aucune validit\u00e9.<\/p>\n<p>Effectivement, ant\u00e9rieurement \u00e0 la loi de s\u00e9curisation de l\u2019emploi du 14 juin 2013, date des faits, il n\u2019\u00e9tait pas possible, m\u00eame par avenant, d\u2019augmenter la dur\u00e9e du travail d\u2019un salari\u00e9 \u00e0 temps partiel pour la porter au niveau de la dur\u00e9e l\u00e9gale ou conventionnelle applicable dans l\u2019entreprise.<\/p>\n<p>N\u00e9anmoins, si <strong>la loi de s\u00e9curisation autorise la signature d\u2019avenants<\/strong>, dans la limite de 8 par an, pour d\u00e9passer la limite des heures compl\u00e9mentaires et augmenter ainsi la dur\u00e9e du travail de l\u2019int\u00e9ress\u00e9, il n\u2019est pas pr\u00e9cis\u00e9 si cela peut avoir pour effet de porter la dur\u00e9e du travail au niveau d\u2019un temps plein.
