{"id":6740,"date":"2016-07-27T18:15:12","date_gmt":"2016-07-27T16:15:12","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=6740"},"modified":"2016-07-25T08:42:07","modified_gmt":"2016-07-25T06:42:07","slug":"mutation-intra-groupe-contrat","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/07\/27\/mutation-intra-groupe-contrat\/","title":{"rendered":"Mutation au sein d&rsquo;un groupe : comment g\u00e9rer la relation contractuelle ?"},"content":{"rendered":"<p>La mutation au sein d\u2019un groupe doit-elle n\u00e9cessairement<strong> s\u2019accompagner d\u2019une rupture conventionnelle <\/strong>pour formaliser la rupture du premier contrat ?<\/p>\n<p>Dans un arr\u00eat du 14 octobre 2014, la Cour de cassation pr\u00e9cise que <strong>le seul mode de rupture amiable possible correspond \u00e0 la rupture conventionnelle<\/strong>, \u00e0 l\u2019exception des situations dans lesquelles l\u00e9galement la rupture d\u2019un commun accord a \u00e9t\u00e9 express\u00e9ment pr\u00e9vue (apprentissage, CDD).<\/p>\n<p>Aussi, la question s\u2019est rapidement pos\u00e9e des cons\u00e9quences de cette d\u00e9cision sur la validit\u00e9 des mutations intra groupe qui \u00a0prennent souvent la forme d\u2019une convention tripartite sign\u00e9e entre le salari\u00e9 et ses deux employeurs successifs, aux termes de laquelle il est, d\u2019une part, mis fin au contrat de travail initial avec le premier employeur, d\u2019autre part, il y est conclu un nouveau contrat de travail avec le nouvel employeur, pr\u00e9voyant une reprise de l\u2019anciennet\u00e9.<\/p>\n<p>Dans cette affaire, la Cour de cassation r\u00e9sout une certaine ins\u00e9curit\u00e9 juridique qui r\u00e9gnait depuis 2014 en validant la pratique des ruptures d\u2019un commun accord, en cas de mobilit\u00e9 intra-groupe.
