{"id":6760,"date":"2016-08-16T10:00:28","date_gmt":"2016-08-16T08:00:28","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=6760"},"modified":"2016-08-16T10:00:28","modified_gmt":"2016-08-16T08:00:28","slug":"inaptitude-reclassement-formation","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/08\/16\/inaptitude-reclassement-formation\/","title":{"rendered":"Un employeur doit-il former le salari\u00e9 inapte \u00e0 un autre m\u00e9tier ?"},"content":{"rendered":"<p>Suite \u00e0 une <strong>reconnaissance d\u2019inaptitude<\/strong>, l\u2019employeur est-il tenu, dans le cadre de son obligation de reclassement, \u00e0 une<strong> obligation de formation sur un autre m\u00e9tier ?<\/strong><\/p>\n<p>Que l\u2019inaptitude soit d\u2019origine professionnelle ou non, l\u2019employeur est toujours tenu \u00e0 une <strong>obligation de recherche de reclassement<\/strong> en tenant compte des recommandations du m\u00e9decin du travail eu \u00e9gard aux nouvelles capacit\u00e9s du salari\u00e9, sauf si depuis la loi Rebsamen, le m\u00e9decin estime que le maintien du salari\u00e9 dans l\u2019entreprise serait pr\u00e9judiciable \u00e0 sa sant\u00e9. Cette exception, r\u00e9serv\u00e9e aux inaptitudes professionnelles\u00a0&#8211;\u00a0qui n\u2019est pas sans soulever certaines difficult\u00e9s comme nous l\u2019avons \u00e9voqu\u00e9 dans une pr\u00e9c\u00e9dente veille\u00a0&#8211;\u00a0<strong>devrait \u00eatre \u00e9tendue \u00e0 toutes les inaptitudes<\/strong> par la loi El Khomri.<\/p>\n<p>Pour effectuer cette recherche, l\u2019employeur doit tenir compte de l\u2019ancien poste du salari\u00e9 pour lui proposer un poste similaire ou, \u00e0 d\u00e9faut, inf\u00e9rieur dans l\u2019entreprise ou le groupe en assortissant sa proposition d\u2019un engagement \u00e0 lui d\u00e9livrer une formation d\u2019adaptation, sans que cela corresponde \u00e0 une obligation de formation sur un nouveau m\u00e9tier.<\/p>\n<p>Ainsi, un menuisier d\u00e9clar\u00e9 inapte avec un reclassement possible sur un \u00ab\u00a0poste ne comportant pas de mouvement forc\u00e9 du poignet\u00a0\u00bb est licenci\u00e9 mais il conteste la validit\u00e9 du licenciement estimant que des postes administratifs ou commerciaux auraient d\u00fb lui \u00eatre propos\u00e9s avec une formation ad hoc.
