{"id":6790,"date":"2016-08-17T10:02:12","date_gmt":"2016-08-17T08:02:12","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=6790"},"modified":"2016-08-16T10:02:41","modified_gmt":"2016-08-16T08:02:41","slug":"licenciement-economique-representants-personnel","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/08\/17\/licenciement-economique-representants-personnel\/","title":{"rendered":"Licenciement \u00e9conomique : dans quelle situation consulter les repr\u00e9sentants du personnel ?"},"content":{"rendered":"<p>Quelles sont les cons\u00e9quences<strong> si un licenciement \u00e9conomique est prononc\u00e9 sans consultation des repr\u00e9sentants du personnel ? <\/strong><\/p>\n<p>Il s\u2019agit dans cette affaire d\u2019une interpr\u00e9tation des textes qui ont \u00e9t\u00e9 soumis \u00e0 recodification en 2008.<\/p>\n<p>En effet, l\u2019article L.\u00a01235-15 du code du travail pr\u00e9voit qu\u2019\u00ab\u00a0est irr\u00e9guli\u00e8re toute proc\u00e9dure de licenciement pour motif \u00e9conomique dans <strong>une entreprise o\u00f9 le comit\u00e9 d\u2019entreprise ou les d\u00e9l\u00e9gu\u00e9s du personnel n\u2019ont pas \u00e9t\u00e9 mis en place<\/strong> alors qu\u2019elle est assujettie \u00e0 cette obligation et qu\u2019aucun proc\u00e8s-verbal de carence n\u2019a \u00e9t\u00e9 \u00e9tabli. Le salari\u00e9 a droit \u00e0 une indemnit\u00e9 \u00e0 la charge de l\u2019employeur qui ne peut \u00eatre inf\u00e9rieure \u00e0 un mois de salaire brut, sans pr\u00e9judice des indemnit\u00e9s de licenciement et de pr\u00e9avis \u00bb.<\/p>\n<p>Semble donc vis\u00e9e par ce texte toute proc\u00e9dure de licenciement pour motif \u00e9conomique.<\/p>\n<p>N\u00e9anmoins, l\u2019ancien article, \u00e0 savoir l\u2019article L.321-2-1 du Code du travail, pr\u00e9voyait que \u00ab\u00a0dans les entreprises employant au moins 50 salari\u00e9s o\u00f9 le comit\u00e9 d\u2019entreprise n\u2019a pas \u00e9t\u00e9 mis en place alors qu\u2019aucun PV de carence n\u2019a \u00e9t\u00e9 \u00e9tabli et dans les entreprises employant au moins 11 salari\u00e9s o\u00f9 aucun PV de carence n\u2019a \u00e9t\u00e9 \u00e9tabli, tout licenciement \u00e9conomique s\u2019effectuant, sans que de ce fait, les obligations d\u2019information, de r\u00e9union et de consultation du comit\u00e9 d\u2019entreprise ou des d\u00e9l\u00e9gu\u00e9s du personnel soient respect\u00e9es est irr\u00e9gulier. Le salari\u00e9 ainsi licenci\u00e9 a droit \u00e0 une indemnit\u00e9 qui ne peut \u00eatre inf\u00e9rieure \u00e0 un mois de salaire brut sans pr\u00e9judice des indemnit\u00e9s de licenciement et de pr\u00e9avis qui sont par ailleurs dues\u00a0\u00bb.<\/p>\n<p>Ce texte <strong>ne concernait que donc les proc\u00e9dures de licenciement collectif<\/strong> g\u00e9n\u00e9rant l\u2019obligation de consultation.<\/p>\n<p>Or, en l\u2019esp\u00e8ce, il s\u2019agissait d\u2019un salari\u00e9 qui, ayant refus\u00e9 une modification de son contrat, \u00e9tait licenci\u00e9 pour motif \u00e9conomique avec adh\u00e9sion \u00e0 l\u2019\u00e9poque \u00e0 la convention de reclassement personnalis\u00e9, remplac\u00e9e depuis par le contrat de s\u00e9curisation professionnelle. Estimant qu\u2019il n\u2019y avait pas eu consultation des d\u00e9l\u00e9gu\u00e9s du personnel, en raison de l\u2019absence d\u2019\u00e9lections et de tout PV\u00a0de carence, l\u2019int\u00e9ress\u00e9 demande r\u00e9paration pour irr\u00e9gularit\u00e9 de proc\u00e9dure.<\/p>\n<p>N\u00e9anmoins, <strong>la Cour de cassation rejette la demande<\/strong> dans la mesure o\u00f9 la codification s\u2019\u00e9tant faite, par principe \u00e0 droit constant, il ne pouvait b\u00e9n\u00e9ficier de dommages int\u00e9r\u00eats dans le cadre d\u2019une proc\u00e9dure de licenciement \u00e9conomique individuel.<\/p>\n<p><em>Source &#8211;\u00a0Cass. soc., 19 mai, no 14-10251<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Quelles sont les cons\u00e9quences si un licenciement \u00e9conomique est prononc\u00e9 sans consultation des repr\u00e9sentants du personnel ?
