{"id":6795,"date":"2016-08-16T09:15:42","date_gmt":"2016-08-16T07:15:42","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=6795"},"modified":"2016-08-16T09:15:42","modified_gmt":"2016-08-16T07:15:42","slug":"prevention-harcelement-moral","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/08\/16\/prevention-harcelement-moral\/","title":{"rendered":"Pr\u00e9vention du harc\u00e8lement moral : l&rsquo;obligation de s\u00e9curit\u00e9 de r\u00e9sultat assouplie"},"content":{"rendered":"<p>Dans cette affaire, un agent de fabrication de radiateurs tubulaires, licenci\u00e9 pour inaptitude physique apr\u00e8s avoir demand\u00e9, dans un premier temps, la r\u00e9siliation judiciaire de son contrat de travail aux torts de son employeur, demande en justice des dommages-int\u00e9r\u00eats pour <strong>harc\u00e8lement moral<\/strong> en raison d\u2019un conflit personnel avec son sup\u00e9rieur hi\u00e9rarchique.<\/p>\n<p>Mais, la cour d&rsquo;appel rejette sa demande estimant que <strong>l\u2019employeur avait agi d\u00e8s la connaissance des faits<\/strong> puisqu&rsquo;il \u00ab\u00a0justifiait avoir modifi\u00e9 son r\u00e8glement int\u00e9rieur pour y ins\u00e9rer une proc\u00e9dure d&rsquo;alerte en mati\u00e8re de harc\u00e8lement moral, avoir mis en oeuvre une enqu\u00eate interne sur la r\u00e9alit\u00e9 des faits, une r\u00e9union de m\u00e9diation avec le m\u00e9decin du travail, le directeur des ressources humaines et trois membres du CHSCT en prenant la d\u00e9cision au cours de cette r\u00e9union d&rsquo;organiser une mission de m\u00e9diation pendant 3 mois entre les deux salari\u00e9s en cause, confi\u00e9e au DRH\u00a0\u00bb.<\/p>\n<p>Or, la Cour de cassation va casser la d\u00e9cision estimant que s\u2019il ne peut rien \u00eatre reproch\u00e9 \u00e0 l\u2019employeur sur la gestion a posteriori de la situation, il n\u2019est pas mis en \u00e9vidence que l\u2019employeur avait mis en \u0153uvre des actions d\u2019information et de formation propres \u00e0 <strong>pr\u00e9venir la survenance de faits de harc\u00e8lement moral<\/strong>.<\/p>\n<p>La d\u00e9cision peut para\u00eetre s\u00e9v\u00e8re mais en r\u00e9alit\u00e9, elle vient confirmer une position amorc\u00e9e avec l&rsquo;arr\u00eat \u00ab\u00a0Air France\u00a0\u00bb du 25 novembre 2015 (n\u00b0 14-24.444) dans lequel la Cour de cassation infl\u00e9chit sa position sur la port\u00e9e de l&rsquo;obligation de s\u00e9curit\u00e9 de r\u00e9sultat en acceptant de tenir compte des mesures de pr\u00e9vention mises en oeuvre par l&rsquo;entreprise pour reconna\u00eetre qu&rsquo;elle avait bien respect\u00e9 son obligation de s\u00e9curit\u00e9 \u00e0 l&rsquo;occasion d&rsquo;un contentieux relatif \u00e0 un steward ayant d\u00e9velopp\u00e9 un syndrome post-traumatique suite aux attentats du 11 septembre 2001.<\/p>\n<p>Cet arr\u00eat aurait pu \u00eatre consid\u00e9r\u00e9 comme un arr\u00eat d\u2019esp\u00e8ce eu \u00e9gard aux \u00e9v\u00e9nements en cause.
